If the hospital has admitted that they originally billed the wrong insurance co. and then they did not file the claim with the correct insurance until their contracted time limitations was expired, this is not your debt. It is considered to be "out of timely filing" The only part of the debt that you are libel for is your part of the total or your deductable. If you insurance would have originally paid for the total claim then you do not owe anything. The best and quickest way to get the attention of the hospital is to contact the hospital Utilization Board.(The Utilization Board is in place to review any problems that have occured during a patients visit or irregularities in the billing of the patient's treatments) They can take the hospital visit from beginning to end, including the billing and any payments from your insurance company, they will review EVERYTHING. Tell them the problem you have had with patient financial services and ask them for a total review. Because the claim billed to your insurance is "out of timely filing", the hospital has to take it as a loss and cannot legally bill you for the insurance company non payment. The hospital has a contract with the insurance companies and has to comply by filing claims in a timely manner. The screw up was the hospital's and as such it is their loss. You should be able to find more information by looking at the federal guidelines for the hospital and the contract that they have with your insurance company. As a patient you have a legal right to view this information.

The hospital has a UTILIZATION REVUE BOARD that has the clout to correct this problem. You have Federal "patients rights" to help you.The billing departments hate seeing the U.R.B coming in to check out a snag.Call URB and request an investigation into the problem...
