does anyone here know if a CA has a legal right to change charges or credits on an Oc paperwork? I had a CA send me validation for a debt that is 4 yrs old, I noticed the charges were added incorrectly making the balance due lower, I informed them of this error in writing and agreed to pay that amount. the Ca scratches out other figures on this statement and changes them . claiming that the OC had other errors as well thats why the balance is wrong. they change these figures to make the bal higher. and attempt to collect it, I do not see how this is validation, I sent a letter to the Oc explaining this and they are now backing up the CA in an attempt to collect more $. I am hoping this is a FDCPA violation here.
Misrepresenting the amount, character, or legal status of the debt. The problem will be that in order to resolve the problem, you will probably have to argue that the original documentation is correct, and force them to provide actual records to disprove the original documentation which they provided. Of course, the best part is that either one of the two times they misrepresented the amount of the debt, so by trying to wiggle out of one violation, they are wiggling into another offense of the same violation. One of which they will be able to claim a bona fide error on (the first one), but only if they can provide the actual records to back up the alterations in the documentation. If they can't then it looks as if they misrepresented everything to match the higher balance, just because they thought that they could get away with it, and that would fall into willful & negligent non-compliance.
