Okay, I sent off a validation letter to one of my Fiances CA certified mail. Well today we get a letter back saying "Per our client, because of the hassle of getting this straightened out. We will remove this from the credit bureaus on July 20th. This will generally take them 60 to 90 days to update their files." First off, I dont trust this CA at all, that whole part about 60 to 90 days to update their(meaning cra's) files... I stated in my letter that if the information they were providing was not validated or deleted within 30 days, I would file a lawsuite. Now he is saying oh we will delete, but it takes them 60 to 90 days for it to show on your file.. I already have a attorney on retainer for my business however I want this stuff done now, not wait for a court date and all that stuff.. To much of a hassel. When I feel I have the proof staring me in the face from this company. Option one : If I were to fax disputes to EXP and TU with this letter along with my Validation letter and copy of the green card would you think it would be a automatic deletion? She can no longer dispute them online as they are coming back "previously validated" or "validated" Equifax is the only one who deleted it way back when she was trying to work on her credit herself. Option two : I send a fax back to this CA stating it should take less then 2 business days once you submit the account for deletion to the CRA's.. yadda yadda.. Which way should I go.. Thanks again.. Here's what I would do J. I'd go ahead and send a dispute in to the CRA's, via CRRR, of course. I'd take that letter and BLACK OUT (redact) their silly reason for removing the account, leaving only reference to the fact that they are ordering it removed. (Redact a copy first and then make a photo copy of that. Can't see through it that way). This will reduce your time from 90 days to 30 per FCRA. Should be deleted fairly quickly. Re: Re: It actually worked..one more ? Thanks, I hadnt thought about blacking out the days until they deleted it great idea. I wil be mailing these in on Monday.. Of course after I check my reports to see if the CA actually did what they said and submitted a deletion to the CRA's Then I will give it a week after the CRA's recieve it, if I have no luck and the tradeline is not gone.. I am going to fax a letter explaining to the CA that thier thirty days will be up on 08/08/2003 and insert my statement of "validate or delete within 30 days or I will file suit" What could it hurt.. It actually isnt her account.. at least from what she has told me.. So might as well play the hand while I have it. Think I should put in my letter to the CRA's asking how they validated the account with the CA when they were totally unable to provide me anything in reference to it? Or do you think it would be like poking a bear with a short stick.. a no win situation..
