i wrote in last night on my origional post titled " BEING SUED - NEED HELP ASAP " expressing my thanx for all the help from the great people on this forum EXPECIALLY ENIGMA whom helped me LOTS & without his very much valued help i'd still be sitting here like a worried lil girl getting almost nothing accomplished except worrying ........... if you read my last post on that thread it'll explain some of how it all happened yesterday ............ i now have a new question .......... since ive now ANSWERED this " in my opinion " crooked lawyers complaint --- WHAT CAN I EXPECT & IN HOW LONG SHOULD I EXPECT "SOMETHING" ?????? i just want to once again say this & this i absolutely mean , WITHOUT the help from this forum theres zero doubt in my mind the otherside would have won via a default judgement becouse even though i don't concider myself dumb by any means when it comes to legal matters expecially our court system im a stupid 30 yr old chic that is still very intimiated tackeling anything to do w the legal system ...... yes i could lose this lawsuit but at least i'll not go down w/o a fight --- THANX ENIGMA ............... if you guys could maybe give me somekind of an idea of what i can now expect since i gave them an ANSWER wow that would be great !!! thanx - Julie , brave - well maybe BUT still a scared chic , oh hell yes I AM !!!!!!
guys any idea's on what i can now expect from the enemies side since ive officially filed my ANSWER to their complaint ??? any idea's on apx how long before i might here something ??? do you think i'll here something from the courts OR their attorney since it looks as if im representing myself ??? ANY idea's is more than i know now so anything helps thanx guys , Julie ..............
Read the Rules of Civil Procedure for your jurisdiction. They will give you an idea of what to expect and what you need to do to continue to press your side of the case.
It could very well be that nothing happens. Often times, Plaintiff's in these types of suits do not press forward after receiving a responsive pleading. This type of pleading allows them to ignore the whole suit as opposed to a counter or in some cases, a dispostive motion. Personally, I would hold off on any type of discovery until first served myself or faced with a dispositive motion (rare without some discovery). If no further action progresses in a timely fashion, file a Motion to Dismiss for Failure to Prosecute. It should be Rule 41 if your Court adheres to the federal rules.
thanx APEX I HOPE UR RIGHT ! this is my plan - ** IF ** this fly by night thing of a lawfirm CONTINUES to come after me EVEN THOUGH im broke w NO assets & im sure they know this fact then i guess i'll have no other choice but to file chapter 7 BK as im sad to say i've been told by a BK attorney i do qualify for a complete 7 ......... im not gonna lie , I'D RATHER NOT HAVE TO FILE simply cause my fico is apx 640 or so & my credit's not trashed by any means but theres no way i can allow this garbage thing of a lawfirm harrass me & garnish my low wages ............. i hope ur right though APEX but guess time will tell ............. i hope im not waiting like 2 mths to hear something from either them or the courts but its sounds by what you say the longer the better ....... well thanx again --- Julie ........................
