Judgement and checking or savings

    If a debter has a judgement against him can they freeze a checking account or savings account if the only income this person has is direct deposit of his social security and va oension?

    Can they freeze it? Of course they can.

    Are they supposed to freeze it? No.

    Chances are they will freeze it and then you will have to go to court to make your case about your exemptions and if you don't do that well or to the satisfaction of the judge, they get to keep your money.

    So, if you want to prevent this from happening, you need to file your exemptions with the court and make sure the court knows that the funds in that account are exempt. Otherwise, you can be in for some major inconvenience.
