Judgement assistance

    Sorry so long.

    I made some big mistakes in the past. I feel that I have learned my lesson, and would like to do what I can fix the biggest mistake I've ever made in my credit life. I am looking for advice on different approaches on how to fix this.

    In early 2000, I needed to make repairs on my auto. I desperately needed $$$, so I decided to get a check loan for $450. I had made the first few payments on time, then I was laid off. I called to discuss with them what had happened, and to arrange payments, but they would not work with me. I did what I could to make the payments, but fell behind. They told me I was in violation of the law, and totally closed me off.

    About 5 weeks later I found a new job. But the damage was already done. I recieved a letter stating that the original loan had been defaulted, and now there were other fees that I had to pay. It totaled up like this.

    Original remaining balance: $250
    State of Utah Fine: $500
    Late charges and other fees $300

    Total = $1150

    I was stupid and paid the balance just to make everything right, knowing I had been ripped off.

    A year later it was time to get into a better car, so I went down and applied, only to find out that I had an open judgement against me. I had never even heard of a judgement until then. I had never recieved anything ever telling me about this. So I contacted the check loan place and requested that they fix it. They said they would and that was that.

    4 years later I decided to check my credit, and the judgement was still there, and OPEN! I freaked out. I contacted them again, and this time they changed it to satisfied.

    Now I want it gone, and I need advice as to what direction to take. I am in a time of my life when credit really matters most. I want the best for my soon to be family, but with this hurting my credit score so badly, I feel handicapped already.

    Go down to the courthouse where the judgment was filed, and get a copy of all the papers involved in the case. That would be your first step. You are looking for several things, including when it was filed, when it was granted, and how that corresponds to the date you paid, how were you served, etc.

    Some other questions -

    Have you tried to dispute this with the CRA's?
    Have you moved since the judgment was filed?

    They never take it off the report when we make it right so why should we take it off the docket when they do?

    I have not moved since this has happened. And I have not tried to dispute this yet. No action on my part has been taken yet. I don't want to just jump in on this, I really want to be cautious so that I don't make any errors. I would like to get the paperwork from the court, I just need to find out what court it is.

    You said you never got any papers concerning this judgment.

    Perhaps you can get the documentation from the court and see if you were properly served notice of their suit against you.

    It is possible that you might get the judgment vacated for improper service. Then it would be pretty easy to get it removed from your CR's.

    The CRA that lists the judgment can give you that information

    If you haven't moved it is probably your local civil court or small claims court

    Notice how it was also satisfied the same month that it was filed? I am going to get a copy of the court file, but I have to order it, and it may take awhile.

    Did you pay the balance before they got the judgment? or did you pay after you were served with a summons?

    When you get copies of the papers from the court, you might want to let a lawyer look through them to see if there are any grounds to have the judgment vacated. If you can get that then you have a chance to have it removed from your CR, especially since it has been paid

    I was never served with a summons. I never had any clue that a judgement was being put against me. It was a year later when I tried to get a new car that I found out about it.

    I tried to make a payment after I got the new job, but was told the account was on hold.

    I recieved a letter a bit later that showed the total amount now owed, and saying that they would now accept payment

    I paid that amount that week, but never recieved a summons or was informed about a judgement

    If you were not properly served before the judgment was entered you should be able to get it vacated, on off your CR

    a lawyer should be able to help you, or else the clerk of the court will help you file your motion to vacate

    sounds like they were purposely "holding" your account, maybe because they were waiting for a default judgment. Long shot but who knows.....I can't imagine wanting to pay a debt and the creditor won't accept pmt because the account is on hold? RO ROH RAGGY something is rotten here!

    Sounds like the judgement may have been filed for while your account was on hold. I would be interested in knowing the filing date at the court, and matching that against your payment date. Did you get a receipt for payment, or pay by check where you can see what that date was?
