While living in another state a court ,in the previous state I lived,issued a summons in their local newspaper for me to appear re: a civil suit. According to an attorney this is legal to do in the state of Utah. A default judgment was issued against me for items never in my possession. I applied for an apartment and was denied because of a judgment. That is how I found out I had one against me for the amount of $83.00. I called the court and found that a library, where i never had a card or checked out books, was suing me for non-returned items. Because no ID or signature is required there is no way to prove I was not the one who did this. I told the court I will pay nevertheless but I want the judgment removed. It will remain on my credit until 2008. They would not work with me at all. How can I fight this major discrepency? This affects my ability for an apt or financing a car, etc. Any insight would help. You are not the first to have this happen. Do a search here for "library" and you should find a bunch. They are having the same problem and the library won't work with them either. Did you live in that area when the alleged book heist took place? IF not, you should be able to show them that.
