My little sister has to go to magistrate court in GA on Tuesday for a payday loan that she could not pay back. The payday company agreed to take $50 a month on the loan (she borrowed $200 and paid back $400 six months later) . They went before the judge and he said if they had an agreement, go sign an agreement and get back to him. The payday loan company wanted her to sign a docunment with no $ amount or date only the wording "I agree to pay the payday loan company $50 a month until the balance is paid off" I thought this was illegal and unwise to sign and advised her to have a legal aid attorney look at the letter before she signed it. They could easily added on any fees that wanted if she signed that blank agreement The payday company went back to court the next day and told the judge that she broke her promise. On Wednesday, the judge immeditely filed a garnishment judgement aganist her for the total amount plus court cost. She did not not the payday loan company went back to court the next day so she was not there. It seems that the judge has taken the side of the payday company or acted on a lie from the company. Does anyone know how to set aside the judgement and who do you complain about the judge's actions to. It is bad enough to be poor in Georgia the legal should not make the situation worst. Any advice would be helpful at this point.
