Hi everyone. I recieved a collection letter dated 5/2/01 on 5/27/01 stated that I owed a bill. This letter was from an attorney . I sent check out next day. Unknown to me,they drew up papers also on 5/2/01 for a consumer credit transaction(judgement).They filed this on 5/29/01,2 days after I informed them that payment in full had been sent. They start sending letters wanting more.The amounts varied each month going up & down by hundreds of dollars.I say that I am not paying more,that they should not have filed after payment was made. They file for summary judgement for 474.50 plus interest & fees. They win a judgment of $795.00 I had already paid them $474.50. On friday that froze my bank accounts without telling me the total of the judgemnt.(the judgement was worded so that no exact amount was given,a call to the court house got me the amount of the judgement)I had my bank send them the money just to get my accounts unfrozen.The problem is, they took $427.56!!! If you do the math, the amount should be $320.00.The sherriffs office & the courthouse both agree that too much was taken. !)I would have paid this d*ck,if he had sent me a final figure. 2)he already reported it on our credit reports & there is no mention of the payment nor any account info(the date of last activity) 3)he gave the sheriff an incorrect amount for the judgement,he took to much,is this fraud? 4)What should I do? These people are jerks,they called me a "proffesional debitor" & white trash on the phone after I paid them!!!! They called me 2 to 3 times daily & several times i got hang ups that when i used *69,itr went back to them. I just wanted to get rid of these people.I have stressed over this for a year. I did the right thing,i paid the bill as soon as i was notified about it & i still got screwed...... ughhhhhh Sorry about venting but i want this guy to pay.He literally stole money from me!!!!!!
They haven't called me since i blew up at him and called him several words i choose not to repeat....lol I live in NY
Look, you need to get the judgment vacated for improper service, and 10 days after judgment they can't touch your bank account. What was this for, do you know? You have rights. I would make damn sure about all of this.
I was sent a letter (by regular mail,not certified) of the summary judgement.I recieved a letter from court saying they had won a judgement,but no exact amount was listed.How can you pay the differance if the amount was never told to you? The court never told me an exact amount untill after my bank account was frozen & i had to call the court house to get that amount.....
The difference may well be court cost. A creditor is allowed to recover those cost. Get your file from the courthouse and it should show how the final figure was determined.
That is the first thing i thought,but the court clerk said that court costs were included in the $795 total
