Hello, I was wondering if anyone knew the laws about judgements, specifically about being served court summons papers, etc. The reason I ask is because on my EX report only it shows 2 judgements from 2 years ago. I was never made aware that I was being sued or that a judgement was filed against me. Doesn't the Plantiff have to prove to the court that I was served or that every attempt to serve me has been made because I would of showed up for those judgements if given a chance. I lived in the same place for over 5 years. I need to know what you all suggest as my best approach to getting rid of those on my report. Thanks in advance,
Doesn't the Plantiff have to prove to the court that I was served or that every attempt to serve me has been made ****************************** No because a Plantiff don't have the authority to serve anyone.
They do have to file a proof of service with the court. They probably filed a perjurious one in order to get the default judgment against you.
