Hi Hubby had a judgment. We are in Calif. I was served papers at our home when hubby wasn't there around dec 2001. In March got a settlement offer from a thier lawyer We made one payment per agreement and haven't since (shame on us but we couldn't really afford the payments. The "judgment is not showing up it is still being reported as charge off from the company as of May 2002 . We finally now have heard back from the gov and we have a large tax refund "in the mail" . Should we challange the judgement and make sure it really exists ? or just pay it , any clue how to offer to pay in exchange for vacating the judgement so it never shows up ? Thanks in advance the fact that is is a supposed judgement and I am dealing with a lawyer I feel uneasy about pushing any issues Any advice ? Jamie
Your post makes no sense. You were served papers in 2001 for a debt that was charged off in 2002? Were the papers you were served actual court papers with a docket#? If so, call the court clerk and find out the disposiion of that case. Was this a personal debt?,a credit card debt? There were several cases of strange goings on in Cal. circuit courts that were part of a class action that voided service on filings. Do a google search undr the lawyer's name and see if they were the same ones.
Hi Weird huh ? The company is leasecomm. It is listed as an installment loan on hubbys report it was for a personally guarenteed loan he had for a business we had to walk away from. I have jugement papers doc number etc. hubby never went to court. On his experian report is being reported as a past due collection acct date of status is May 2002...(I misspoke when I called it a charge-off sorry about the confusion). No judgement regarding this has shown up yet. So I want to pay this in exchange for getting it vacated... I will check on the lawyers name thanks Jamie
This may or may not be relevant to your case. I just received this URL in a letter from LeaseComm today.
