ISAC turned my husband's student loans over to Wexler and Wexler who obtained a judgment. We set up payments and have paid every month. They took our tax refund last year before the payment plan was set up. Can they take it again this year even though we are making on time payments? Or should we just not plan on getting any refunds until this is paid off?
How do I find out if that information is in the judgment? I have tried calling Wexler and ISAC and cannot get anyone to respond to my calls. Filed a complaint with the DOE. Still have heard nothing.
If they took it last year and have a judgement, then they will take it this year. Adjust his witholdings as much as possible to eliminate the amount of tax return. That way it will go to him during year instead of student loan. They will keep your refunds as long as they have a judgement. How certain are you that they have a judgement? Did they just tell you that?
Claim single 1 or 2 on your W4, this will allow your husband to receive the most money in each paycheck while making sure their is enough to cover taxes. Be advised you won't be getting anything back though. You should both file seperately until this judgement is resolved. Tac
So I'm not the only person with the ISAC monkey on their back! They're horrible- aren't they? Anyway- have you tried calling the ISAC directly to find out? From what I understand, they only take refunds if you are delinquent AND do not have an acceptable payment plan worked out with them. Is there any way you can go on their loan rehab program?
If they've gone to a judgement, they'll have to be vacated before they can be rehabbed or consolidated. It is possible to work with some guarantors who will vacate the judgement upon the debtor signing a new promissory note to cover the loans, court costs, CA fees, etc... I don't understand why they took this all the way to a judgement when they can garnish wages and take tax refunds without one. Kimd9760, are you positive they obtained a judgment? (have you checked the court papers?)
If you haven't filed yet, file and check the box that you want the tax refund to go to next year's tax liability. Next, change the number of dependents to like 6 so that less money is taken out for taxes. This way, you've paid a chunk of taxes for next year (actually this year) and virtually no Fed. tax will be withheld from wages.
