    1. Wouldn't any claim of "improper service" be sort of nullified by the fact that she *did* receive the served papers and respond to them?
    2. By "play possum", do you mean don't show up for court?
    3. When you say "There's no real defendant there unless there's a corporation or LLC", are you sure about this? Since "Company X" is, in fact, herself...isn't she still the "real defendant"?
    4. Don't they just scan the records for names? If so, then if her name doesn't appear in any public record, isn't it true that there's very little risk of this judgement showing up on her personal credit report(s)?
    5** #4 is most important, if anyone knows. If I'm right about that one, she's not going to worry about the rest. She'll just "let it ride", lose the case, pay it, and go get the money back from the former employee.

    1*No Improper service isn't just not getting served it can also be errors in the complaint and or the papers served.
    2*Do that and she won't be playing possum;she'll be dead.

    4*No they just report the info about the items they find .
    5* If she does this-She should not be suprised it this winds up on the CRAs telcheck and chexsystems.

    She didn't have a bank account of her own, and the bank (B of A) that the check was drawn on would charge her a fee to cash it because she's a non-customer.

    You don't have to be a customer to cash a check at the bank the check was drawn on.
    Such bank has an obligation to honor their own checks with no obligation of the check payee..

    It seems to be going the way of trading stamps and free silverware at the gas pump. And apparently banking regulators are allowing it. Mr. Potter has replaced George Bailey.

    Banks that are cashing checks drawn on their accountholders accounts for non-customers are increasingly doing so on sharper and sharper terms.

    SPEAKING OF CASHING CHECKS...mom gave my wife a check for CHRISTMAS and she took it to mom's bank to cash...wife had to give DL...CREDIT CARD...FINGER PRINT...I DON'T KNOW WHAT ELSE...TO CASH MY MOTHERS CHECK ($100)...AND MY MOTHER WAS WITH HER!!!!!!!

    SHE WAS THIS [] CLOSE TO TAKING ALL HER MONEY OUT!!!!

    Had I known I would have left her $100 CASH before I left...

    Next time just take your "stool sample" and put it on the counter.

    When they arrest you, you should get plenty of press.

    How is your friends mom doing and how did her day in court go.?
