judgemnet help sorry long but need

    A couple of weeks ago I recieved a letter in the mail which was not certified just mailed with a court date and time for suit against me. Well I called the lawyer to see what the balance of the loan was so I could pay this off. Well I was told $1792 I said okay and then asked about some kinda of arrangements I could make they said $500 on the first and $200 each month after til its paid.Well they sent me a consent judgement form and after talking to a friend about this they said that it was not good to sign one of those so why dont I just pay half now and half before court and that would be that. Well I sent $700 on the 15th and I thought that would leave me only $1092 to pay so I called them to let them know I would be in monday morning with the rest well the lady said the pay off is around 2230 but she would have to call the finance company to get exact figures when I come in.On my credit report that I have from the last two months the oc reports only 1792 they did this in 5/02 i disputed and came back verified 7/02 for 1792. The lawyers off is saying I owe the 1792 442 in int.,110 court cost and 554 atty. fees.I told them I cant afford that all I can give is the 1092 I thought I owed so can we work out something. She said I would have to bring in the money first then see what they can do since I did not sign the consent judgement and did not keep the agreement i played dumb and said yes I did I sent 700, $500 for the first month and the $200 for august in advance.Please help court is July 31....Can they still sue me if I pay the 1092 which will cover the 1792 on my report. They have already cashed my check which I made out to the OC... Please help

    teesha,
    First I will tell you that since you acknowledged the letter the court will consider you properly served. My advice to you is to save the final payment and go to court on the date it is scheduled. If the lawyer won't settle for the agreed upon amount then tell your story to the judge. You did not say what state you are in...if you tell me I can check on what the interest should be. Also I would need the charge-off date.

    Don't be afraid of going to court. I know it is a scary thought but it isn't as bad as you think. The atty's office is trying to intimidate you right now and with the support of the people here...we will hold your hand all the way to court.

    I live in louisiana and the charge off day is 11/2001. my high credit was $2974 and they being the oc reported it with a balance of $1792 in 7/2002.Well I hope now I can get off from work after seeing my credit report and being told balance was 1792 I sent the 700 and was going to send the rest monday.Which would have paid this off before court.I thought I had to acknowledge to the court I got the date not them the letter was from the court and from what I thought I was suppose to get served the papers not have they mailed. The reason I scared to go to court is because I do not want to be garnished.This is my last credit entry I had left to work on. Any advice helpful..
