Judgment Question

    Okay so -

    I need to be clarified in my fuzzy understanding of judgments.

    a) CA files a judgment.
    b) CA negotiates with that filing
    c) Debtor pays the money
    d) It never goes to court

    Does that mean the case was dismissed and there really is no filing? I am a little confused on this. I had a judgment filed against me but it never went to court. Does the filing still stand? Can I get the filing off my CR by disputing it?

    Original CA now out of business.

    A judgment cannot be entered without a court proceeding.

    A lawsuit may have been filed seeking a judgment against you. If the case was not heard a judgment was not entered.

    Well, that's what I think happened.

    I am going to get a copy of the record and see what it says - judgment or FILING for judgment suit.

    if it does say that a judgment was filed, I am going to try and get a motion to dismiss - it's been two years, but I think discovery would show that PLUS the CA is no longer in business. According to records, he let his business licence go in 2000.

    How sad. :)
