    Going to judgment hearing for credit card debt. OC's attorney is asking 21% interest from 4/01. Interest rate for open account in OH is 10%. How can he ask more?

    Credit report has last payment as 8/02 with last date of activity 5/01.
    I have cancelled checks I did make payments through 8/02. I was on a hardship payment plan and made smaller payments. These count as payments I would think.

    All he submitted to court was a copy of his paperwork the store had given him the account to collect. Court told him to supply history of payment or contract.

    If he does provide one or both to the court, can I still get the judgment denied based that I did make payments after 4/01 and the legal interest is only 10%? Or by showing my checks am I admitting guilt?
