JUDGMENTS - Advice Needed!

    I hope I can keep this short. Here goes.

    1990 - Purchased vehicle.

    1994 - Stopped paying, gave company loation for voluntary repo, but can't prove this. They "short-sold" it and came after me for the balance, but couldn't find me. They had current address.

    1995 - Plaintiff filed suit.

    1996 - Service by publication in paper in town where
    we had not lived for 1-1/2 years. Subsequent judgment by default.

    1998 - Recorded judgment.

    I'm still researching info on judgements, but wanted to get some input as to some possible courses of action to get it off the 1 CR it is on.

    When I go to purchase a home it won't be in the same county as the judgment, so if I can get it off my CR I may be home free.

    file a motion to vacate judgement. Tell the court that you were not properly served and that the plaintiff DID have your current address but purjored themselves when they claimed that they did not and then served by publicaton.

    Slam dunk.
