Jus twhen I think things are fine and dandy for the last few months with the CR's. Today, Lazarus(FDS Bank) posts 4-30 day and 1-60 day lates. I've had these off since last year and they are back again. Lazarus was posting to my Equifax monthly with zero lates for the last 6 months. NOW THIS. Score went from 719 to 687. Damn!!!!!!!!!!!!!!!!!!
So, once they've deleted something, the CRA can't reinsert it? I am helping my bud clean up her credit. JCPenny's was disputed off in January. Reappeared in March. When we called up TU, they said, "If the creditor reports it, we have to report it" Thats not true? If not, can someone post a reinsertion letter? I have to dial up, and my connection is slow. I always time out when trying to do a search. Thanks in advance.
They can, but there is a procedure they must follow. From the FCRA: B) Requirements relating to reinsertion of previously deleted material. (i) Certification of accuracy of information. If any information is deleted from a consumer's file pursuant to subparagraph (A), the information may not be reinserted in the file by the consumer reporting agency unless the person who furnishes the information certifies that the information is complete and accurate. (ii) Notice to consumer. If any information that has been deleted from a consumer's file pursuant to subparagraph (A) is reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing not later than 5 business days after the reinsertion or, if authorized by the consumer for that purpose, by any other means available to the agency. (iii) Additional information. As part of, or in addition to, the notice under clause (ii), a consumer reporting agency shall provide to a consumer in writing not later than 5 business days after the date of the reinsertion (I) a statement that the disputed information has been reinserted; (II) the business name and address of any furnisher of information contacted and the telephone number of such furnisher, if reasonably available, or of any furnisher of information that contacted the consumer reporting agency, in connection with the reinsertion of such information; and (III) a notice that the consumer has the right to add a statement to the consumer's file disputing the accuracy or completeness of the disputed information. TU CSR's are idiots. I hope they don't "notify" you now. Thats why I said wait 5 Business Days.
Now that's funny!!!!! I'll wait the 5 days and then get out a letter requesting the certification. I'm going to get a letter out to the "Credit Review Board" for Lazarus, copies of my CR tot he supervisor that I spoke with that couldn't believe the lates weren't showing on the CR, letter disputing the account to the local CSC branch and then dispute it with EQ in Atlanta I believe. This, as has been successful for me in the past will have this account tied up umong many people at once and hopefully will cause it to fall off again.
