    OK, well, I think it's good to hit them from all sides...
    I have not much faith in Budd Hibbs..I guess I was unlucky but I wrote him once about some credit thing and he told me that using CreditExpert was hurting my credit score...sorta lost faith in him. Nevertheless, I'm not familiar with his letters. I personally always just sent validation, then wait, dispute. To be honest I check state stuff first cuz if that applies, I use my state violation letter instead of the others..but that's just me..

    Darn, no licensing or bonding that I can see..BUT....then you move on to checking the states that the CA is in....so...what have we got for CA's state(s)?

    Hi NanaC! Thank you for your help. From what I understand, they do not require liscensure here, but you must be bonded. I've pasted below what I saw on LawDog.com. I'm just not real clear on out of state agencies. We seem to have a liscensure code for out of state exempt. I sent an e-mail to the Department of Consumer Affairs yesterday, but have yet to hear back. Here's what lawdog says:

    Collection agencies are required to register with the Department of Commerce and Consumer Affairs before conducting any collection activities in the State of Hawaii. A bond is required in the penal sum of $25,000 for the first office, and $15,000 for each additional office. All collection agencies must comply with all statutes, rules and regulations set forth in Chapter 443B of the Hawaii Revised Statutes, and Title 16, Chapter 112 of the Hawaii Administrative Rules.

    Hi, Nervous..let me explain about out-of-state...if they are in, say, CO, they must also be licensed properly in CO...so you check the requirements for agencies in the state they (the CA) are in, also.

    Here's a real example..I was once dealing with a CA in IL that requires licenses...I was in CO...I checked the IL licensing and they were not licensed actively..and it was immediately removed because of that even though I lived in CO..

    Let me look more into the Hawaii bonding :)

    Oh, yes..you are absolutely right, they require bonding. So contact that address and find out if the CA's are bonded..but also check out the state the CA's are in, too...:)

    Good Afternoon NanaC! Thank you so much for your help and input. I don't suppose you know of a database where I can look up the various agencies and where they are or are not liscensed/bonded? Anything other than LawDog? I'm sending another e-mail to a different department at Commerce and Consumer Affairs (this one to consumer protection) and hoping they respond. Thank you again! NuB

    Hmm...I always use Lawdog..then go to the individual states and they usually have a licensing listing (if applicable)..tell me a state(s) and I'll see what I can find for you..:)

    I want to tackle Minnesota in a bad way, then Illinois and California. Minnesota didn't even bother to validate with me (30 days are up), Illinois has to be bogus, and California I just have to figure out how I'm going to deal with them....just thorns. Thank you! NuB

    Illinois is good..you can search on line..will get that for you..CA..I think won't help much..and I need to double check minnesota..will be back with info..:)

    Neither of you are liscensed collection agencies in your state. Please delete your tradelines from the reporting agencies within 5 days of the reciept of this letter. NuB

    Trent,

    You can't get validation once you've removed communication.

    Why do you think a C&D gets the debt returned to the OC???? It may get you sued though, since you've removed all other means of resolution.

    Flying with Nana on Bud Hibbs and his cease communication letter -- better verify it's accuracy with the statutes before depending on it. Same for any letter you find online.

    I thank you so much NanaC! I just fired off an e-mail to Minnesota Commerce to verify that they are not lisenced.....and so that I will have a letter to include in my letter to the CA from their own state. I read your post and letter...the MN site only says 'no listing found'... with no reference to what I searched for... so I'm hoping for something a little more specific this way. They have a ton of violations. Thanks again! NuB

    Great..I'm hoping this is the state you requested this from, not the CA, right? :) Congrats!

    No, Trent..I really don't think so...sue? It isillegal for them to come after you now..imagine if they compounded the violations and sued...and the state is behind YOU!
