Last 3 tough ones! Help!

    Well, I'm down to 3 derogs on Equifax and did I metnion I HATE EQUIFAX????!!!!!!

    So far, I've disputed these as never late, wrong DOLA and wrong date opened. I have the good old pull every day Credit Watch so I've been monitoring these for a while now.

    Here's what I have left - need help getting rid of them. Have never asked for a procedure request. Not sure what to do next:

    GMAC - Closed (paid off in good standing) in 1997, opened in 94. From November of last year (when I started this project) the lates have changed back and forth from 4x30days and 1x60 days to 1x30 days and 0 x 60 days. All of this has been fluctuating on an account that has been closed since 97. Since November, the lates have probably changed 4 or 5 times. After disputing this time, it went from 1x30 to 2x30. I've tried 1 goodwill to them some time ago but no help there. ALSO, I disputed the date opened as wrong (1994) and it came back with the additional late and now the date opened and date closed are both showing 12/97. Let's see, how can I have paid on a vehicle 3 1/2 years (paid it off early even) and the date opened and date closed be the same. HOW DO THEY GET AWAY WITH THIS CRAP!!!

    LOWE'S - Same scenario except the account is still open. The number of lates has fluctuated 3-4 times over the last 4 months. I have paid on time the past year. How can the number of lates keep changing???? I disputed as wrong high balance and it not only came back verified, they re-inserted 2x60 that had previously gone away.

    Finally - DISCOVER - This account has been in terrible standing for a long time. I've been paying on time for the last 18 mos. but it is over limit, terrible interest and closed by credit grantor.
    The first time or two I disputed, came back verified and just decided not to deal with it for a while.
    Well.... Back in February, around 2/20 this account showed up as CONSUMER DISPUTES. I had not disputed it since CHOD, when it was verified. This just showed up all of the sudden. Well, I let it alone, hoping it would fall off. Did some disputes on 3/25 that the results are back in on and STILL, they show Discover in dispute. Should I point out that it has been in "dispute" (even though I didn't put it there) since 2/20 and demand deletion??
    It's got multiple 60 and 90 days from several years ago.

    Thanks for any help guys - these really have me stumped and I'm SO close now (on EQ anyway).

    It's only with the help of CN that I've been able to do this.

    I wish I could give some advice. I have a closed Discover account with lates from 1998 that EQ also refuses to investigate. Both TU and EX have deleted the lates. I have sent EQ three separate procedural requests on the account and they have refused to answer any of them. I even called up customer service on the phone, and they verbally confirmed to me that they refused to answer procedural requests. I couldn't believe it. So there's an easy violation for you.

    My next step was to contact an attorney. He advised me to send a letter directly to Discover and demand a verification of proof that the debt belongs to me and that the payments were in fact made late. (I think he wants to go after Discover, although I want to go after EQ instead.) I'll know more in 30 days when I do or do not get a response from Discover.

    I'm really concerned at this point about the fact that EQ just keeps arbitrarily changing the number of lates on these items, whether being disputed at the time or not. The GMAC thing is old but still has a year ( a little over ) before the sol. I tried a goodwill with Lowe's as well to no avail. I'm obviously not getting the right person. A phone call maybe? PFB maybe?

    I'm really looking to call EQ's hand on this. How can I have any faith that any of it is accurate when it's not even being reported the same from one day to the next. I'm thinking a letter to them outlining what has happened with these three accounts since Feb. and quoting the FCRA on the accuracy issue I've seen quoted here before and stating that I'll sue if they don't delete the negative marks.

    Yep, I too have heard Discover can be a tough one. Wish I had the cash to try to settle and work for a deletion but not gonna happen anytime soon. I've got a new card that I think I'm going to at least do a partial BT to in order to get under limit and kill some of the fees and interest charges. The new card has 0% for 9 mos. on BT. Also, got a notice in a Disc bill a month or two ago that their late payment charges and over limit are all increasing. Talk about gouging people!! That's how the balance originally got to be nearly twice the original CL.

    Please keep some suggestions coming on this! I need ideas and to hear about other's similar experiences! Thanks - gotta get these last three off so I'l have ONE clean report....I'm so close and have renewed motivation now!

    Before doing any BT to Discover, I would contact them and ask what lump sum they would settle for as complete payment. Use the BT availability to close this out if possible rather than just BTing and still being stuck with the whole bill.

    As for the late payments constantly changing... what makes you think it is Equifax rather than Discover? Normally, a cra reports only the info given to it. What possible reason would Equifax have for changing this? I'd be willing to bet that it keeps changing due to being reported that way.
