I am sending my last letter to a CA asking that a TL be corrected. This will be my third CMRRR letter. I found out about a collection through my credit reports that belongs to my exwife. I immediately sent a validation letter the day I was notified of the new TL and disputed the account. They simply sent me a copy of her bill, with her name, and her address. I followed up with a second letter asking that the TL be removed. After I sent the initial dispute, the CA continued to report the collection and continues to do so today. Before filing a lawsuit, what should my next step be? If I do need to file a lawsuit, do I simply do so with my local small claims court? I've spent the last six months working daily to get this and other problems corrected and it looks like it is now lawsuit time. I just want to give the CAs one more chance to correct these problems. I am not really interested in filing lawsuits, I don't have the time and my goal is just to get my CRs corrected.
Are you sure that you weren't a joint owner on this account? Did she have the account before you got divorced or did she open it afterward? Did she use your SSN? My friend's ex used his SSN to open a card after they were divorced. He knew nothing about it. But because she had used his SSN, the only way to get rid of it was to go after her for identity theft. So, make sure what the status is before you decide what avenue you need to pursue. There may be more here than meets the eye.
I know the status. The CA told me that this should be her responsibility. They told me just to pay it and then get my money back from her.
