Late mortgage confusion...

    I found out that I had a 30 day late mortgage payment reporting as recently as Dec. 02. I knew in the course of the last few years (2000-2001) I had a couple of 30 day lates. I can deal with that. I know in fact the 12/02 payment was late but NOT 30 days. This recent late is killing all my credit apps.

    I called Homeside Lending (which is now Washington Mutual) and the CSR told me I was not 30 days late in December, that my payment posted on 12/27. I was sweating mailing it late due to the holiday mail etc but it obviously reached them before the 30 days I was so worried about. I told her it was reporting late on all 3 CR's and after looking at my account she tells me they have NEVER REPORTED ME LATE. EVER. I still think I've been late a couple of times, just not the 5/6 they're reporting.

    She did fax me a letter to meet my needs of my loan officer for my refinance on my house but now I need to know how to get this off of my CR's.

    I told her I had disputed the info with all 3 CRA's as never late and they all came back verified. She proceeded to tell me that was not possible - they couldn't have verified that. WHAT NOW???

    I do have a letter in my possession concerning the December payment and can send that on to the CRA but don't want to open another investigation as never late since we've been there, done that. Do I write a letter? Do I call someone at each CRA and find out who to send the letter to?? Threaten a suit? I was going to let the other lates go but now I'm really pissed and want to get these lates off of my reports.

    Any and all suggestions welcome!

    I see having some fun with this one. Can you get a letter from the mortgage company that says they never verified the lates with the CRA?

    Then you threaten to sue the CRA.

    I thought mort companies were able to reports you 30 days late to the cra's after 15's days. I understood they do this b/c the cra's don't have a 15 day late designation, but are interested enough in mort lates that they still want to report them...

    I wouldn't be surprised to find that they CAN, but the point is - my lender DIDN'T and the CRA is claiming they verified this.

    As far as a letter - they sent me one already about the 30 day late in December but I'm going to have to call them back about the others. I was just trying to address that one to get my refinance finished. Now I want to push to get the others removed. I'll call tomorrow about getting verification of never being 30 days late. We'll see what they can provide.

    Right... my point was that maybe the CSR you were talking to was looking at the payment post dates and said that you weren't reported as 30 days since none of your payments posted past 30 days... maybe she was actually unaware of their posting criteria...?

    My MORTGAGE payments are DUE the 1st day of the month...on day 16...I WOULD HAVE TO ADD A LATE FEE...

    I hear what you guys are saying and I paid the late fees if it was going to be received by them after the 15th. I'm not really questioning if they were "considered" late, I was questioning if they were "reported" late. The mortgage co. tells me no. I obviously need to call them again and get some clarification here. Yes, they were late but I made every effort not to let them go the full 30 days late for reporting purposes. Reporting them 30 days late if they are not, goes back to the old question asked here many times before - is it being ACCURATELY reported???? No, not if it is 15, 20 or 25 days late. Yes, it's late, but not 30 days late. I'll pay the fee, I'll do better next time.....WHATEVER. It's not 30 days until 30 days and I'll argue that point forever!! Now - just getting the mortgage company to give me the info needed to prove it. Thanks for all the insight - just trying to decide on a course of action.

    If the MORTGAGE COMPANY can write a letter to you saying you
    were NEVER LATE/PAID AS AGREED...then you can send it to the CRA'S...that MIGHT work...or have them just send their own letter for you to the CRA'S.
