late pay validated now what?

    Hi,

    I am down to the last late pay on TU report. it is from 1999. I disputed it and within 10 days it came back validated...

    what do i do now?

    I want that one off!!! :)

    Have you tried contating the OC and see if they will delete the late pay? It worked for me on 3 accounts. I called explained my situation and they took care of the rest. Didn't even need to write a goodwill letter.

    you mean just call them?

    what about if they sold my account late last yr? can i still call?

    I was referring to a late payment listing with the OC. If the account was sold to a CA, that's a different story. I suppose you could contact them and ask them as a gesture of goodwill would they delete the late mark. However, I don't think the term goodwill is in the CA's vocabulary.

    In case I misunderstood your question. I presume that the account had been turned over to a CA. However, if this is not the case and it was simply sold to another creditor it still my work.

    Case in point, my Syms account had 2 - 30 day late marks. The OC was GE but was later sold to Monogram Bank. I contacted Monogram and they were kind enough to delete, the whole tradeline as a matter of fact.

    So yes, in that case it's possible.

    nope never had an account turned over to a collection agency

    just that they sold the acct... it was like a PLUS loan my mom took out for schooling

    i will call them on monday

    Hi Allen,

    You've done well in a short time, good job.

    In your case, since the debt was sold, the new owner is considered as the OC.

    I'd just call them and see if you can get their co-operation. It's not an adversarial relationship.

    actually it wasnt sold i think... just that a processing service is now handling the customer service for them...

    blah this one is going to be hard i know it!

    Allen,

    Even better in that case, have you sent them a validation letter requesting a statement of accounting to substantiate their reporting? or you have only disputed with TU and it came back verified?

    Yeap, all I did was disput it with Trans Union... it is not on the other reports so I am kinda worried that if I screw up they will report it there.

    So I am contemplating not doing anything..

    I really want to buy a house!

    What is a validation letter? I thought it was only for bankruptcies?

    Nope, not just for BK's, probably works best with everything but a BK, lol.

    There's a link in the FAQ tagged at the top of the messages to the sample letters on the site.

    A validation letter disputes the accuracy of a tradeline, or some part of it, and requires that documentation supporting what the creditor alleges be provided to you.

    Pretty much a prove it or remove it concept provided for in the FDCPA.

    Since he said it had not been turned over to collections I gathered that Allen has this current account and is still making pmts. on it. He just has a cpl. lates to remove. If that is the case the acct. was sold NOT in default, in which case the new owner would still be an original creditor. Allows for megers and buyouts.

    Maybe I gathered incorrectly? You're right, I shoulda clarified.

    If it is in the hands of the OC an FDCPA val demand may not work. Allen we really need to know what's going on here. Are you still making pmt.s? If not how delinquent is it? Has it defaulted?

    If it's a student loan it's probably an installment contract and FCBA won't work either.


    If a clients account is "farmed out" to a customer service firm that indicates it's still active and has not defaulted.

    Don't do anything yet Allen until you UNCONFUSE us.

    OK let me try to clear all this up...I just woke up so I will try to do my best :)

    It is with Bank of Boston. For all purposes, it is a regular installment loan.

    I am 100% current with the loan. I had one late pay in 1999 I want removed so that my TU report will be totally clean.

    Have you tried calling the CSR to see if they will remove it? Or maybe then a goodwill letter, if you're still making payments (heck, even if you're not, it worked for me on a closed account)
    If it's only one late payment, it shouldn't be too hard to get taken care of. I had 31 90+ days late taken care of w/ a simple goodwill suckup letter (I still for the life of me don't know why they did that, but I'm not going to argue) and they left the positive tradeline, which gave me a 15 yr tradeline!
    Just keep plugging away at it! Try to dispute w/ TU again in a month or so!
