A local law firm representing Midland Funding for a First Consumers National Bank CC (FCNB filed BK in 2003) account (charged off April 2004) is asking me to produce a "Fraud Affidavit" in a recent letter. Here's some history: Same law firm attempted to serve me with lawsuit in August 2007. Their service was ruled improper by the Court and I heard nothing from them until I received a letter this week. (Coincidentally, my husband had recently settled an account with them and paid them off, which revived their interest in this account, I think.) I sent a validation letter last August 2007 which they ignored. Here's the letter: --------------------------------------------------------------------- My Name Re: Midland Credit Management, Inc. vs. (my name) ( ) County Court Case No. xxxxxxxx Our File No. xxxxxxxx Please find enclosed a copy of the billing statement from our client along with a demand letter that was mailed to your current address. Also enclosed is a Fraud Affidavit. Please review these documents and, if applicable, complete the fraud affidavit to the best of your ability. Please return the completed fraud affidavit to our office so that we can forward it on to our client to research.
