Hello, I was wondering if it was possible to initiate a lawsuit after changes were made to the report. Many of you know I have been battling Ford and Equifax since April and Trans Union since July over reporting my Ford account wrong. I finally have someone from Ford making a manual report clearing up all errors. I have suffered due to the error (high loan rate an inability to refinance). The last person I spoke to state that a 60 day late in July of this year and a 90 day late in April of this year is killing my application. He stated there is no way the computer will let it go through. So, again, can I sue even though they finally have corrected the error. I have a clear line of attempts by me trying to rectify the situation unsuccessfully. Mike G.
I think you can sue any company at any time for anything.... the question is will you win a judgement. I understand your frustration with the credit reporting agencies and your creditor, but if you notice, most people here are using small claims court as a means to get the deletions they are legally owed, not for a financial award. If you're strictly going after money, you need to take your case to a lawyer and ask his opinion. If he thinks he can win the case, he's going to want a percentage of the award. You're also looking at a long long time before you collect anything. Good luck, but I would consider myself lucky and happy where you are now if I were you.
I see your point Bkev. Actually, I was hoping to get the CRAs to delete some inquiries or other potential negative information in return. I had not even thought of financial damages. I believe lizardking was able to get all negative information removed in his lawsuits; however, this was before the problem was resolved. Mike G.
