Lawsuit - Damages?

    I'm planning to sue Experian for reporting a tradeline as a charge-off, when the account was the subject of litigation--and subsequently settled by me and Subaru Credit. Experian (TransUnion and Equifax have deleted the tradeline) continues to report it as a charge-off AFTER I've sent them copies of the relevant lawsuit documents as well as the notice of settlement filed with the court. They claim to have verified the entry with Subaru.

    My question to those who have sued successfully: what have you alleged as your ACTUAL damages? I'm concerned that walking into small claims court without showing the actual damages that I incurred might get my case dismissed. Thanks in advance.

    Denial of new credit line
    Denial of existing credit line increase
    Higher cost of credit terms than would be without derog on file=existing credit lines (difficult to prove unless it's your only derog)
    Higher cost of credit terms on new credit line than would be given without error on file

    Best advice given on this subject: go to a local bank. Ask for a specific credit line (5k for example, less if your small claims court limit is less, say 1k). get denied by your local bank. that way if you need to subpeona the bank employee or manager they're local.

    I wouldn't file a lawsuit without actual damages. There is only one company that I know of that accesses damages:

    Before filing a lawsuit, contact Subaru and ask them if the CRA ever contacted them about it. If not, include the fraud in the lawsuit (didn't really investigate). If Subaru did verify it, then they violated the terms of your settlement with them... and they can be held liable. But I'd ask Subaru first. If they say "no: we've never been contacted" get it in writing and then you have the CRA cold
