I am still battling on the lawsuit I wrote about before. OC's attorney has failed to answer interrogatories so I have filed a motion to compel. I don't believe they have any kind of real evidence and this will nail down the case. If they do have evidence I need to see and investigate it. After this I will probably file a Motion to Dismiss as Breeze has suggested. Interestingly I pulled my Exp CR tonight and the tl has been updated from Charge Off to No Status and a balance of 0. It also now says Account in dispute under FCBA and Account closed at grantor's request. I am not sure what to think of this. I filed a validation and disputed the account shortly after filing my response. I don't know if this is due to the court case or validation request. My guess is the latter. I do like seeing the charge off, any payment dates, and balance go off the report. Any idea if I can use this in court now that the only date is opened 1995 and $0 bal as of 2001? As always thanks for any and all help!
I can't print who the OC is now. I will after I get this case taken care of. I am being sued for a charge off that I believe is my ex-wifes.
Hmmmm, with a status of "no status" and a balance of 0 - I think the question is, now, what are they suing you for? Move to dismiss.
Yep! Except I think this comes from the dispute I sent to a totally different address for the OC. I need to see results of discovery which I think will be a big zero. Thanks very much for your help Breeze!
Confirmed that the charge off was changed to no status closed by grantor on another report and nuked along with almost everything on another CR. I am sill not sure if the countersuit got this or the validation to a totally seperate address, probably the former. Now if they will just settle!
