I have seen some recent posts about lawsuits against the CRA's and I was wondering about other lawsuits that were filed. If you filed or know someone who filed a lawsuit against any of the CRA's please posts some specifics with the results. thanks
Things I remember reading.... TU settles fairly easily at the first sign of a filing, EX is somewhere in the middle, and EQ will most probably go to court and put up a fight. Expect EQ to bring every shred of paperwork you ever sent to them to use in their defense. EX's attorney lies under oath. Again, TU does not like court. Here is a great thread with lots of links: http://consumers.creditnet.com/straighttalk/board/showthread.php?s=&pgnum=1&postid=282181#post282181
In my case, it was the exact opposite: TU continued to resist with the threat of filing, so I filed and reached a settlement after filing. EQ folded immediately after filing. EXP fought the entire way and sent Carla Blair to represent them in court. Unruly
I filed in federal and I can't decide if they are: 1) Really going to fight me 2) The lawyers for the CRA are just attempting to rack up billable hours before settling I tend to lean towards option #2. But in any case, I am proceeding as thought the CRA is really going to fight.
exp will fight. prepare for the blair. I called today because I now have to call them to dispute anything and kim hughes told me I have to talk with carla blair. Hell no. She said the only way for her to handle my file is if I file a federal court case. Heck, it may be worth it just so I never see blair again. I am sure I will lose my small claims though so on appeal here she comes again.
