This is for a friend of mine. Home is in his name AND spouse name. They ran into some difficulties, one of spouse accounts went to court (just her name), judgement against her. Account (credit card) was solely her name, he was not even a signer on account. South Carolina law, can they place lean on home? Obviuosly they can, the true question, can they legally do this? The lean was discovered when they attempted to refinance the home, and could not get financing since lean had to be paid first as opposed to a part of closing?? Never heard of this. Somehow, lean dosn't look like it spelled correctly for this instance.
