First off, I have no idea how they knew to call me at my parents house (possibly because me and my father have the same name). I don't even no if it was the same CA. The first contact I had regarding this account was back in 06/03, I had no recollection and I told them I would call back. I never did and forgot about it. I live on the other side of the country and I get a call regarding the same account (Wed). I told them to send me some type of paperwork. I gave him my address and thats basically it. During this conversation I failed to get his name and address. When I get this "bill" I will send them a validation letter.
Re: Re: Re: Re: Re: Legal Action Per the law: after they have notified you, IN WRITING; "(b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector. "

However once they hear from you be it during or after the 30 days they no longer have the right to assume the debt is valid. Also responding after the 30 days does not cause you to forfeit or loose any of your rights. >---------L---------B-------------------5---------9-------->> Like I said the 30 day bit is directed at the CA rather than the consumer.
Re: Re: Re: Re: Re: Re: Legal Action Well S&A Collections out of Watertown, NY sent me a letter today regarding this debt. Simply stating the balance and that I needed to call them witin the week. This letter had "no" minny Miranda on it stating I had thirty days to dispute. I sent them a validation letter about an hour after I recieved their BS letter. I guess all I can do now is wait to see what happens. Thanks for all the help.
