legal business name

    I am dealing with a CA and want to pursue small claims however there is a problem with the business name.


    I looked up the sec of state corporations it appears the company was suspended in 1992 dont know why.

    however there is a new corporation name with the same business address filed in 1994

    ck with city licensing under the new corporations name and they are doing business under the old suspended name.

    example recvd a letter from say john collections
    looked up the SOS and shows suspended however new company name listed for the same business address. and gives agent for process.

    im confused do i use the name on my Ca letters and list the agent for service name that this company has a city license under or do i use both as old name DBA new name and list the agent for process.

    im confused any help would be nice.

    The name of the NEW business is the one you need to use on your notice to defendent :)


    Serve the agent of service for the new co as well.

    UNLESS they are just using the same office/address and have nothing to do with the old co :)
