I'm really hoping someone can give some advise regarding this issue. I'll give a brief overview. My mom is retired, and decided to do something with her time by working for a temp agency. She was placed at a company and the job that she did required use of some chemicals. My mom had severe reactions to the chemicals, and was told by the temp agency not to worry about it. After a while, it got bad enough that she had to quit the job. She then had to go to a hospital and incurred medical expenses. (The medical problems seemed to stop after she had quit the job, and gradually got better) To cut a long story short, she had filed a claim with the company, and they initially said they'd pay, but ended up not paying it. Her insurance company paid for part of the expenses. During the fight with the company to pay, the hospital started collections proceedings. At this point now, she has been served a summons by the hospital stating that failure to respond to the summons within 20 days would cause a judgement to be placed against her to pay the expenses and other fees incurred by the plaintiff (the hospital). Now because of this collections and possible judgement, I'm pretty sure my mom's otherwise excellent credit, is ruined. She is ready to pay the amount because she's tired of fighting with the temp agency. Is it possible to negotiate with the hospital for pay for removal even though they've issued a summons? In other words, any hope for a happy ending to this?
Did mom notify the temp agency and the company about the reaction she had to teh chemicals? This is a Workers Compensation Insurance issue, has been from day one. You don't give any time frame, but if it's at the attorney stage it has to be quite old. It is possible it may be time-barred at this time for a Workers Compensation claim. The otehr side of teh coin is that in many states, ifa worker is injured on the job and does not take workers compensation, teh worker retains teh right to sue the employer. \ Mom needs to talk with a workers compensation lawyer. There may be a lot more than either you or she thinks.
