I just received via Federal Express a Mutual Release and I like the language in it except for the following. Maybe I am overconcerned, but wanted to put this out here for the group. The sentence which concerns me: "Further, CA CRAPOLA, LLC agrees not to transfer, convey or sell the account to any entity for purposes of collection." Ok... here is my concern. At the end of that sentence they say for the purpose of collection. Now would this enable them to sell it to another agency or assign/sell it to one of their many dirty underground CA's (this CA goes under many many names, it was quite a challenge to get them to take me seriusosly) they own and then report it while saying that although they are reporting it they are not collecting on the debt, thus leaving me no claim. I feel that the sentence should end "...entity." Your answers would be appreciated as I am in need of faxing this off to them today so that I can get all of the deletions as per the Mutual Release Agreement. Alex
I guess no one had the intestinal fortitude to reply. Well I wanted to report back on my results: I changed the language on the document faxed it and the CA agreed to the modification and signed. 3 TL deletions and 3 inquiries are being removed as a result. The CA finally gave. They had origianlly re-assigned the account to another CA (a sister CA) after I disputed and attempted to collect, but then began to ignore all correspondence until I ITS'd their Registered Agent. Thanks to all the posters here on CNET I was able to make educated decisions which lead up to these deletions.... Alex
