I know there have been alot of questions in regards to debt collections. the law and consumers right to sue. there is much confussion and debate over these issues, some of the experts on CN have cited cases from the US supreme court decisions as well as FCRA & FDCPA laws. most consumers are not aware they may have protection and other legal rights under their own states laws. My questions are these regarding validation from a CA point 1) within the 30 day initial communication from a debt collector if a consumer requests validation of the debt and they inform the Ca/ debt collector the debt is disputed and the CA fails to respond what should be the next action a consumer should take? b) if the consumer has not recieved any notice and the acct is on their CR what action should be taken ? point 2) if the CA has made a hard inquiry on the consumers CR without validation during this time what action should be taken next? point 3) can a debt collector still pursue a consumer for a debt outside the SOL ( not legal action) just attempts to collect AFTER the consumer has request a C&D ? what action ? point 4) if a consumer finds an item on their CR and they disputed with the CRA and it remains and then they contact the furnisher in an attempt to verify and recieve no response what action should be taken? point 5) what action should be taken if the consumer is only given a partial validation during the initial 30 days? point 6) can a consumer ask a creditor for information concerning an acct that was on the credit report they do not agree with and if the creditor doesnt respond what action should be taken? point 7 continued on next post
