I recieved one yesterday for a paid collection along with a release of information. The consumer is requesting that this account be removed from his credit report. What should be my next step here? Fill out the UDF's and fax them in to the bureaus. It's not like it's a lot of work when you think about the potential consequences... Subject: RE: senate call Author: Jim Date: 9/28/2002 10:22 am EDT Reporting to any of the credit bureaus is a public trust, and should ALWAYS be done accurately and truthfully. Mistakes happen from time to time and there are procedures to correct these mistakes from the creditors side, the collection agency side, and consumer side. A threat from a consumer to sue should not be a reason to remove correct and accurate information. We all need to be treated equally and fairly. If you have information that the account was paid, then you must also have all the other pertinent data necessary to justify that report ie. original creditor, last pay, assignment date, and amount assigned, date paid, etc. This area is part of the area where I believe the laws are amiss in that the law does not provide for attorney fees to defend frivilous law suits against collection agencies. I suspect this is why collection agencies acquiese and remove data that should not have been removed. However, a future creditor deserves to know the truth about the consumer. I have some consumers that contine to send consumer dispute verifications over and over to the credit bureaus that I must answer. Some do it monthly. I could say enough is enough, and have this accurate information removed to save myself time. However, I will stand for the truth and what is right every time. As I said it is a matter of public trust. It would be no different than sending disputes to a school and arguing over the grades you received for the classes you took. Again it is a matter of public trust. The opportunity to look at individual reports and verify the information gives me the security that I have been accurate. Over the years I have completed thousands of these forms and can think of only 3 or 4 that were wrong. But none that could be not immediately remedied. The same standards must be applied to all of us. Again remember, a collector is also a consumer in their private life. The powers to be are working very hard to make sure that the system works and is fair to all of us. Should their credit be ruined for 7 years because you are some goody two shoes over here. Are you so perfect that you have done nothing wrong. Has nobody had to forgive for something you have done? As I said in my previous post, there are ways for consumers (including myself) to answer for the happen-stances of our lifes. If the credit bureau has acurate information about us, the creditor has a clear picture about us and came make an honest decision about our credit worthiness. Credit is a freedom and should be utilized in a responsible way. The credit bureaus are one of the reasons we have such a high standard of living in this country. More often than not this is the kind of people we have to deal with all day long. Instead of seeking truth and objectively discussing issues and coming to a meeting of the minds, they simply want to argue and if they have nothing to substantiate their position they attack the other party. People never cease to amaze me. That is one of the many reasons I am a collector. Jim
