letter for collection from lawyer?? long sorry.

    I have been out of work due to medical reasons, etc. So even if they sue me I really do not have money to pay these people. What can happen? I edited names for identity purpose. Also, I am confused about the company they are representing because the original company I got a loan from about a year ago went out of business and stole my account to another local company. Then when I pulled my credit report this month to see if they were on there, they are not. However, now today I get this letter. I would figure the company that the account was sold to would be on the report somewhere and they are not? Do I respond to this letter? Please advice? I looked up attorney and they are in another city. I am in Texas.


    here is the letter....

    Attorneys and Counselors at Law
    January 12, 2010
    VIA U. S. STANDARD MAIL


    I have been retained by Corporation to collect the debt described above. As of today's date, the amount owed is $339.00. Demand is now made for immediate payment of this debt. DIRECT YOUR PAYMENTS TO THIS OFFICE AT THE ADDRESS ABOVE. PAYABLE TO ACCOUNT." Please make a notation of your account number on your cashier's check or money order, so that your account can be properly credited. DO NOT SEND A PERSONAL CHECK OR CASH.
    I have been instructed to make only one demand for payment. If your payment is not made immediately and if no arrangements are made to satisfy this debt, I will proceed with immediate suit against you to collect this debt by all lawful means and through all remedies available at law.
    Please contact this office immediately on receipt of this letter so we can discuss the resolution of this matter. If I have not heard from you within thirty (30) days from the date of this letter, I will recommend to my client that a lawsuit be filed against you to recover this debt. If that occurs, you may be liable for my attorney's fees and the court costs associated with the lawsuit, in addition to the principal amount of this debt noted above.
    Unless, within thirty days from receipt of this letter, you dispute the validity of the debt or any portion of it, I will assume the debt to be valid and proceed in accordance with that assumption. If you notify me in writing within thirty days of receipt that you dispute the debt or any portion of it, I will obtain a verification of the debt and mail it to you.
    I am attempting to collect a debt. Any information obtained will be used for that purpose only.

    No way to know for sure, but they sure look like a scam.

    Gets lots of good advice on here; wait to get a bit before acting; shouldn't take too long.

    I'd say don't acknowledge the debt, do write them and ask them to validate that you entered some contract which incurred this purported debt, and what services/products were received, and to whom, and when.

    Send with delivery conf. and 35 days after you don't hear back send them a letter demanding they go correct their info my deleting you today. Check the bureaus to see if they're reporting this debt and if so at this point notify them to delete too.

    Or if you do in fact hear back in writing from them, then examine the info to see if its sufficiently clear; if not, write them so. If it is, you've got a debt to figure out.

    Send a DV letter CMRRR.

    When you get the green post card back (or see that the letter has been received on the USPS web site) check your credit reports to see if they are reporting the account. If they are, dispute the entry with the CRA.

    It sounds like a CA using lots of legal huff-n-puff to get you to send them money. If they are not attorneys who are licensed to practice law in your state, then you have an FDCPA (at least) violation that might get them to shut up and go away. Ask for thier names and state bar numbers in your DV if you want to stir the pot some more.

    You could have some fun with this. Worst case: they go away. Best case: you get some money from them!

    fyi i checked my credit reports and this company is not on there. I orginally had a loan with a company that went out of business that same month then another company locally got the account. Now this company is send my info to this lawyer. I check my reports nothing on this company. What do i send them? Where is a sample letter? Thanks in advance.

    there's a sample letter section on this forum that was updated few months ago. if u can't find one there, search for one in credit talk and make sure to use a recent one.
