Letter from Lawyers Office

    I received a letter from a lawyers office representing a company that I wrote a check to in 1995. The letter states that I owe the amount of the check plus interest. Isn't it too late for them to collect on this debt? I know it is definitely too late for them to put it on my credit report, correct?

    In most places they can try to collect even if the account is SOL, it just means that if they sue you... you have an absolute defense "Your honor, this account is past the statute of limitations."

    Check your state law (check with a lawyer). Some states have much stricter laws about bad checks than they do about unsecured debt.

    Make sure you know what the Statue of Limitations is on checks before you go to court and assert it as a defense. Yes, they can try to collect even if it's past the SOL. If it is truly past SOL, go to court and use that as a defense.

    I believe that in some states writing a bad check is a felony, and that's a whole different ball game. So make sure you know exactly what this is all about.

    Residents of that state only or out of state residents too?

    I'm pretty sure anything from 95 is waaaay past SOL.

    Send them a C&D...
