Letter I faxed to Experian

    I just faxed this to Experian. I'm fed up.


    Dear Sir/Madame:

    This letter is a formal complaint that you are reporting inaccurate and incomplete credit information. I am upset that you have included the below information in my credit profile and have failed to maintain reasonable procedures in your operations to assure maximum possible accuracy in the credit reports you publish. Credit reporting laws ensure that bureaus such as you report only totally accurate credit information. Every step must be taken to assure the information reported is completely accurate and correct.

    The following derogatory information therefore needs to be re-investigated.

    1) PHEAA, Account #11111111111
    Opened: 11/91 Original Amt: $xxxx
    2) PHEAA, Account #11111111111 Opened: 11/91 Original Amt: $xxxx
    3) PHEAA, Account #11111111111 Opened: 6/92 Original Amt: $xxxx
    4) PHEAA, Account #11111111111 Opened: 6/92 Original Amt: $xxxx
    5) PHEAA/HCB, Account #11111111111 Opened: 3/01 Original Amt: $yyyy
    6) PHEAA/HCB, Account #11111111111 Opened: 3/01 Original Amt: $yyyy
    7) Public Record, Docket# 11111111111

    Items 1 & 2 obviously reference the same account. It is being double-reported by the same creditor. Items 3 & 4 reference another common account. Again, the same creditor is double-reporting a loan. I only took out TWO of these Stafford loans when I attended college, not 4 as is demonstrated here. One was opened in 11/91 and the other in 6/92. Items 5 & 6 are ILLEGAL ENTRIES! I have not opened ANY new accounts with PHEAA â?? these are accounts that have been re-aged!

    I have already taken Wednesday of next week off so I can go down to court and file suit against your company for violating the FCRA by allowing this to occur. Get it off of my report now. When I wake up on Wednesday morning, my report had better not be showing these inaccurate accounts. I have already disputed the duplicate accounts in the past and you claim you have verified them. Iâ??d like to know what exactly you mean by â??verifiedâ?. You have already had your 30 days to properly investigate these accounts so I expect them off this week or suffer the consequences.

    Furthermore, the docket number of the public record you are listing on my report DOES NOT EXIST! How can you say you verified it! If you canâ??t get it right, remove it now!

    Remove these entries from my credit report or face a lawsuit for violations of the FCRA for failure to verify inaccurate information in my file when requested to do so and for failing to maintain adequate measures to ensure only accurate data is kept in my file. Be advised that the description of the procedure used to determine the accuracy and completeness of the information is hereby requested as well, to be provided within 15 days of the completion of your re-investigation.

    Ah, the "suffer the consequences" letter. I love that one! May I ask which fax # you sent it to? I need to send them a little something myself. Thanks, and good luck in your disputes!

    It's a really good letter. Funny thing happened the other day. I called them to get their fax number, I was on speaker phone and my husband was here with me, anyway, the guy was really nice. I hung up and had the letter I was faxing over up on my computer, my husband says, "He was so nice to you on the phone and your going to send that letter?". I told my husband to take a quick look at his credit reports and then tell me how nice they are being.

    Just a little giggle.

    My fiance has this same problem with USA Funds double-reporting loans with the same amount and dates on EXP. The only thing that has stopped us from disputing the duplicates is that the account numbers are the same except for the first number; one reports as acct. #123456, the other as #223456. Does anyone know if these are different accounts, or is this just a tactic used to report the same neg. twice? Thanks in advance.

    I would dispute not only as a duplicate, but the CRA's are reporting the wrong account number.

    To all of you who have double reporting of the same accounts...

    I had two creditors do this to me. I tried the CRA route with no success. Thereafter, I sent letters to the original creditors and ratcheted up the heat a little at a time. First letter, quite cordial, explained the duplication and requested removal. Second letter, somewhat more aggressive, indicated that I was looking into damages. Third letter, very aggressive, said that the damages amount to thousands of dollars and itemized accounts that I had potentially been priced less than optimally as a result of the duplications including a mortgage which my husband and I possibly could have had a more favorable APR but for the duplicates. Told them that as their history of reporting was rife with error that they were no longer to be trusted to report AT ALL. I also told them that if the accounts were not deleted in their entirety that they would be sued for damages as well as attorneys fees and the fee for the financial investigator whom I was about to retain to assess said damages and whose fee was $500 per hour. (true). One company deleted all duplicates and the original account immediately after the third letter. The second company didn't respond so I managed to get a fax number and barraged them with additional letters always including the previous correspondence. At one point I had 12 or 14 pages that I was faxing to them once a week. They, too, capitulated. Both accounts are completely gone. I certainly would have gone ahead and sued if they had not and they were down to the wire. Always give them xx number of days to respond. Make your deadline clear and also exactly what you expect them to do (both in the body of the letter and in a bulleted 'summary'). With duplicates you have a lot of gunpowder in your stockade and they KNOW IT.

    Maybe your letter to Experian will work. Personally, I doubt it very much. If it does, let us know. If it doesn't go after the creditor and don't ever give up because you have lots of ammo.

    Were duplicate accounts being reported by the creditor twice or once by the creditor and once by a collection agency?

    PHEAA is currently screwing my wife too. Let's see if I can't make your system work for her too!

    I am seriously considering it. The lady at PHEAA even told me on the phone that Experian doesn't verify everything they say they do.

    I sent a similar letter to Experian last week CRR. Have not heard anything yet, heck I don't even have the green card back.

    The duplicates were removed before the 30 days. I think it took like a week. The BK stayed.

    Beaker,

    I have the same situation with USA. They are reporting 4 different trade lines with account #s exactly the same except for the first digit. What really fumes me is that California Student aid is reporting the same accounts as well but the numbers are different so as to prevent me from disputing these as duplicated - HOW SLEAZY IS THIS TACTIC???? We need to do something pronto to stop these bastards.

    AMEX is doing this to me. The duplicates were deleted from EX, but I seem to be having a problem with Equifax. Maybe I will go to AMEX directly. I thought it would be a simple thing that anyone with a brain could figure out, but then again, no one at the CRA's has a brain!
