Letter Review Please ...

    CSC decided to list a Withdrawal of an IRS Notice of Federal Tax Lien (NFTL) as a Release rather than leaving the entire record off my report as they should have.

    Please review the attached letter and give me some feedback ...

    To whom it may concern:

    This letter is a formal complaint that CSC/Equifax inaccurately reporting a public record on my credit report. At the end of this message, I am including the Public Record as it is listed on my report for reference.

    The Notice of Federal Tax Lien (NFTL) listed on my credit report was withdrawn by the Internal Revenue Service (IRS), which removes the public notice of the lien. The IRS has the authority to withdraw a NFTL under Federal law. The law states that when a notice of withdrawal is filed, the original Notice of Federal Tax Lien will be treated as if it had never been filed.

    In my case, the IRS should not have filed the NFTL in the first place and has taken appropriate action to correct their mistake; I would hope that CSC/Equifax does the same.

    With the proof that I am attaching to this letter, I am sure you will agree that the Notice of Federal Tax Lien should be deleted from my credit report immediately due the extremely damaging nature of the public record. When reviewing the attached documentary proof, do not make the mistake of treating the Withdrawal the same as a Release. I assure you they are not the same and are treated quite differently under the law.

    In the event that you continue to list the disputed item on my credit report, I may find it necessary to sue you for actual defamation damages and declaratory relief under the FCRA.

    The IRS has corrected their mistake, CSC must do the same. Please delete immediately.

    Not yet...don't play your cards to soon. I like your letter, but don't be so nice. Nice doesn't work with CSC :) Do not ask them to agree with you - tell them they have to delete it!

    When you are reviewing the attached documentary proof of the NFTL withdrawal, do not make the mistake of treating the withdrawal the same as a release. I assure you they are not the same and are treated quite differently under the law.

    The IRS shouldn't have filed the NFTL in the first place and has corrected their mistake; CSC/Equifax must do the same. Please delete this extremely damaging record immediately.

    I am on a roll now ... If CSC/Equifax fails to delete the public record, How does this sound for a Procedural letter?

    Over 30 days ago, I sent a letter to CSC/Equifax disputing the following public record. CSC/Equifax has failed to delete the incorrect and extremely damaging record as prescribed by law.

    This letter is a formal request for the description of the procedures used to determine the accuracy and completeness of the disputed information, including the business name, address, and telephone number of any furnisher of information contacted in connection with this reinvestigation.

    I am disappointed that you have failed to maintain reasonable procedures to assure complete accuracy in the information you publish, and insist you comply with the law by providing the requested information within the 15 days allowed.

    For your benefit, and as a gesture of my goodwill, I am including a copy of the original dispute letter for reference.

    Guess what? The bogus Release showed up on my Experian and TransUnion reports recently.

    More news ...

    I decided check out what Dolan Information had on file at the same time I was taking care of CSC. The record was showing up as a Release with Dolan Information.

    Dolan Information was very nice and fixed the records in two days. They even set it up in their database so the records would not propagate again. In addition, they sent letters to all of the "Big 3" CRA's with the updated info.

    I have now sent disputes to the Big 3 CRA's via CMRRR ... I dare them to verify. I have in my hand the records from the County Clerk, a signed letter from the IRS, and now I have a nice letter from Dolan Information / LexisNexis. Priceless !!!

    Just checked today ... The Federal Tax Lein is gone from my Equifax/CSC report.

    Damn that was fast!

    One more deletion ... The Federal Tax Lein is now gone from my TransUnion report.

    Wow ... Experian just deleted!

    Dolan Information, Equifax/CSC, TransUnion, and Experian all deleted my NFTL in 2 weeks or less.
