Letter Review PLEASE!!!!!!!!

    Wolpoff and Abramson are very nasty, so I want to get feedback before I send ANYTHING to them. I don't want to screw up.

    This is not a refusal to pay, but a notice that the information you are reporting on our consumer credit reports is being disputed. This is a request for validation made pursuant to the Fair Debt Collection Practices Act.

    My wife and I have been MBNA customers since 1988, and for the first 14 years of my association with MBNA, I had nothing but pleasant encounters. Their representatives had always been considerate to me.

    In the Fall of 2001, I began to experience a hardship in my life when my wifeâ??s hours were drastically cut at work, and unfortunately, I fell behind on my payments. At this time, I panicked and began speaking to a debt negotiation company. By Spring 2002, I had realized too late that this was not the way to resolve my problems.

    By this time, your company had taken over both my accounts. I explained my situation to your representative, and she worked with me to set up a payment plan to get my account current. For that I was, and still am, very thankful; it made a very stressful time a bit easier.

    Since that time, I have made regular payments to Wolpoff and Abramson and I am making a concerted effort to lower my balances. Since May 2002, I have paid $3120 on the credit card account and $3756 on the Gold Option account (please see attached records). It is important to me to prove my creditworthiness after the bumps in the past, and I have been working diligently to meet that goal with both my MBNA accounts.

    In light of all this, I was taken by surprise recently when I obtained copies of mine and my wifeâ??s credit reports and discovered that my MBNA credit card account is being reported as currently 60 to 120 days late (depending on the credit reporting agency) and my MBNA gold option account is being reported as being charged off in February 2004. Considering the fact that my last payment was made in March of 2004, I donâ??t understand how this can be.

    I have every intention and desire to pay off both of these accounts; however, I see very little incentive to do so. I have been cooperative with your company from the time you took over my accounts, yet you are reporting such derogatory information on my credit reports.

    I want to resolve this matter in a manner that is mutually beneficial for your company, myself and my wife; therefore, I am making the following proposal:

    ($3756 has been paid since May, 2002)

    $200 paid online with the acceptance of this proposal
    $200 paid April 30, 2004 (post-dated check mailed upon acceptance of this proposal)
    $200 paid May 14, 2004 (post-dated check mailed upon acceptance of this proposal)
    $200 paid May 28, 2004 (post-dated check mailed upon acceptance of this proposal)
    $200 paid June 14, 2004 (post-dated check mailed upon acceptance of this proposal)
    $1000 paid June 30, 2004 (post-dated check mailed upon acceptance of this proposal)

    $2000 total Pay off per this agreement


    W & A File #XXXXXXXXXXXX/MBNA Visa Account
    ($3120 has been paid since May, 2002)

    $175 paid online with the acceptance of this proposal
    $175 paid April 30, 2004 (post-dated check mailed upon acceptance of this proposal)
    $175 paid May 14, 2004 (post-dated check mailed upon acceptance of this proposal)
    $175 paid May 28, 2004 (post-dated check mailed upon acceptance of this proposal)
    $175 paid June 14, 2004 (post-dated check mailed upon acceptance of this proposal)
    $625 paid June 30, 2004 (post-dated check mailed upon acceptance of this proposal)

    $1500 total Pay off per this agreement

    Please advise if you are willing to accept the above payment terms in return for a letter stating that you will immediately (by April 30, 2004), delete all derogatory information from all three credit reporting agency (Equifax, Experian, and TransUnion) reports for both myself and my wife.
    Upon receipt and acceptance of your letter agreeing to these terms, I will immediately make the 2 online payments listed above and forward to you all 10 post-dated checks as listed above.

    Post dated checks will never be accepted by an OC, CA or landlord or anyone in their right mind as they do not make a legal contract. In other words it is not against the law to bounce post dated checks therefore there is very little recourse for the creditor if one does bounce.

    In September of 2002, after I had been paying them for a few months, they talked me into giving them post dated check numbers for 12 months. I did that and they were all honored for the 12 month period. It was after that when they started reporting us as late--even though we continued the payments. We just refused to give them any more check numbers.

    Since they seemed to like this before, I thought I would try it again. I don't have the money to give them one lump sum now, so I thought it might be an alternative that they would accept.

    Does anyone else have any thoughts about the overall letter??
