Hello, I'm sending this letter to a local collection agency for a bank. I called them on the phone and they sent me a lame computer printout with account info on it and an amount to pay.. My thinking is that they cannot take me to court or deal with this account if they can not prove that I have a debt with them (IE- something in writing with MY SIGNATURE)... Anyway here's the letter-- any comments would be greatly appreciated. 09/08/2004 Dear Sir/Madame: I am writing in response to your letter dated 08/30/2004 [copy enclosed]. This is the second letter I have received from you on this matter. Before receiving this second letter I called your office and asked that you send me proof that I owe this account since I do not recognize it. I do not believe that I owe what you claim I owe, and I request that you please provide me with reasonable proof beyond a computer printout that shows I have a contractual obligation to pay this debt. Specifically I am asking that you provide a legal instrument with my signature showing that I agree to pay the debt listed with your agency. I demand that you also send a copy of this dispute to the company that you say I owe money to, so that they do not report this on my credit report. I further demand that if you have reported me to a credit reporting company, you tell them that I do not agree with this debt. Furthermore, I wish to be contacted in writing about this matter. I do not want your agency calling my cell phone to talk about this since it costs me $.35 per minute. Sincerely, Blah Blah Blah...
What is the origin of the "debt"? Did you ever have an account or loan with that bank, or are they claiming you wrote a bad check? Do you have enough information even to determine that?
I actually had an account with a bank that they purchased 3 years ago. So I'm assuming that they can't produce any documentation. You how company acquisitions go.... chain of events Opened account in '95 Stopped paying in 2001 Bank was sold to another bank in 2002 now in CA in 2004....
