I have not posted in a while, and thought things were sailing smoothly along. Before I was informed about these things, Discover obtained a judgement against me in 5/1999, and I haven't heard anything since, and this morning am served with levy papers from the sheriff. He told me I had ten days to straighten this out before they enforce the levy. Do I have any options at all? Is it possible they would wish to settle for less than the judgement, which I won't have within the next 10 days. Is there anything an attorney can help me with, the sheriff said that I wouldn't be able to open the judgement back up, so I am against the wall I think. Does anyone have any experience, or is there anything I can do? Talk about things coming back to haunt you. I am going to call the attorney this afternoon, but don't know what to ask other than if they would settle for less. Thanks so much.
A bird in the hand is worth 2 in the bush. Even with a judgement, creditors have been known to be open to negotiating a settlement. If you do, however, be sure to get it up front in writing. How much money is involved? How likely is it that you would be able to pay it off in a short time? Is garnishing allowed in your state? What is it worth for them to settle, vs. keep messing with this trying to collect the full amount?
That's just it, they haven't tried to collect on this for over five years, and all of a sudden the sheriff shows up with a levy order. After that, and sitting and going through credit reports, and just what is lingering out there, I am meeting with a bankruptcy attny this afternoon to get info on 7 vs 13. Anyone with any experience in this area would be greatly appreciated. I live in Ga, so the exemptions are not very lenient. Several of these creditors have likely forgotten about me, but with two judgements out there, over 10,000 total, I am exploring all my options. I don't want this hanging over me forever. I am self-employed, and if I need credit for anything in the near future, I will have to just count on hubbys' credit. I will only file BK if I can guarantee my home and property. I don't want to include mortgage or property mortgage, though we do have some equity in the house, but since I am filing singulary, and home is in hubby's name with me as co-sign, will that be an issue? I know, ton of questions, but I'm sorry.
