I had a bill from 1991, when I gave birth hich had not been paid. The sent garnishment papers in 1993 and had begun the process, At that time e had another garnishment from my hubby pay and we had assumed that it was completed. NEVER received any correspondence from the creditor never heard from them. Fast forard........Now as of last year they placed a lien on our report. The report states the lien at around $500. When I called the courthouse, they forwarded me to the attorney handling the account. He sent me ONE statement stating that the balance was $1300 including court fees. Question #1-can I have the debt removed because it is after the seven year mark, and i have had no contact with them. Question #2- if i cannot have it removed and must pay, do I go by the actual lien amount, or the amount the lawyer is giving me? I have not made any payment arrangements. Also the lawyer stated that they could not complete the garnishment because of another taking place, but should they not have contacted us? Thanks Lisa
shotcaller Check to see what the SOL is for the state you live in and the state the debt if from, if diferent. Based on what you wrote, I believe that probably the SOL has past and that the debt is no longer collectable. This is not my area of expertise, but I would look at that route first before even considering panicing. fla-tan
