"Litigious Nutcase" with Providian

    Has anyone done one of these for a charge-off with Providian and had any luck. They are listing a charge-off on one of my reports, and thinking sending out the infamous nutcase letter.

    Is your charge off a paid charge off? I sent both the "Nutcase" and "Son of a Nutcase" letter to Providian. Nothing changed, they still keep verifying. Last week sent them a letter telling them that information on the account is reported differently on all three credit reports, and because it was not accurate or consistent reporting they had to delete. Someone suggested this to me. If Providian pulls an inquiry to see how the account is reported, because they are a closed and a paid account, I've got them!
    I did have success with Assoc/Citi charge off getting deleted using the "Nutcase" and then "son of a nutcase letter".

    It's a paid charge-off. The thing is that it is only remaining on two of the CRA's. I am afraid if I send the nutcase, they might punish me and report again to the other two. But my other two scores are so high, I think I am willing to risk this, becaues I can take a hit.


    How do you think they would respond to a small claims suit??? I really don't have much to lose since they are reporting it as a paid charge-off. They can't really hurt me more than they are now.

    Besides, I never paid it, my fiance paid and negotiated with the CA. Maybe my fiance really did negotiate for deletion with OC, I don't since I never paid it.

    By the way, the CA for PVN really harassed us and bullied their way into payment. They would call and call all day long. Call early morning everyday and wake us up, including weekends, hang up, leave nasty messages, etc. My fiance really just paid the CA to stop the harassment, it was really out of control. They were told to stop calling, but just kept on......this was before we knew anything about FDCPA. If I knew then what I know now......

    i had a paid chargeoff from Providian (small, less than $500, but paid in full) on all 3 reports. After disputing for a few months with each CRA, it fell off (Providian no longer verified), on all three. This was without having to do a LN letter, at least for Providian. I was able to "pick my battles," after a few were solved the easy way, like with Providian and simple disputing tactics.

    In my personal experience, on EQ the Providian tradeline fell off immediately, on EX in took maybe a month (ie, 2 disputes), and TU took maybe 2-3 months, if I recall correctly. I'm far from an expert, but, if you have a few months to spare, I'd recommend disputing first (often these paid collections and chargeoffs will fall right off without additional measures), before taking steps like litigious nutcase letters. Although a very effective tactic---thanks Doc---once you go down the LN road, it's tough to go back. Seems a shame to do so on the "easy" ones...i.e. the ones that would fall off without problem anyhow.
