When you say send with the lawsuit a letter offering to drop in exchange for deletion... I have a question on this. Filing in my county they will serve the registered agent for the CRA's which is Prentice-Hall Corporation in Austin, TX. Will I still send the letter to them (Registered agent) or do I make copies of the lawsuit and then type a letter to each individual CRA offering to drop in exchange for deletion and send it to them CRR? Also tell me again what do I need to say in the affidavit? I am filing against all 3 next week. Oops thought of one more. On my 1 page paperwork in my county for small claims it says the defendant is justly indebted to him (the plaintiff (ME) in the sum of $______ dollars for: _________________________________________ _________________________________________ _________________________________________ (here the nature of the claim must be stated). Is that where I would put $5K or whatever amount as well as listing violations of the FCRA. Thanks and I hope I don't have to ask you any more about this.
Christi, Send you offer of settlement letter to whoever you have served. They will forward it to the right people. If you have 1 party served and then send the letter elsewhere, the people who have the lawsuit may never see it. Yes, that is where you put the amount you are asking for. As for the affidavit, just state that you have never received any response from any of your letters. sign it and have it notarized.
