Lizardking..advice..want to sue JCP

    Lizard, it is because of your stories that I recently sued CAC, and won a settlement, and deletion of a negative tradeline...plus some nice cash....today I was doing my next round of disputes with Equifax...I have tried disputing accounts with original creidtor, as well as CRA....there is one in particular..it is

    Monogram Credit CardBank of GA, JC PENNEY charge...back in 2000, I disputed this trade with JCP/MBGA and got it on Corporate Letterhead, with an officer signature stating they are sorry this fraudulent tradeline has hurt my credit...blah,.blah...blah...

    The letter states that they are advising the 3 cras to remove the debt...It was removed with TU,and EXP..

    It was never removed from EQUIFAX...it is listed as discharged in my CH 7 BK, (which I am working on getting removed from CRAs) but I NEVER INCLUDED THAT DEBT, B/C Jcpenney said it was not mine!!

    I disputed with EQU 3x, and it always comes back verified..

    My question is....

    Who do I sue for the FCRA violation, Equifax, JCP/MBGA, or both? I am going to sue for the $1000.00 violation, and punitive damages of $1500.00 for inconvenience, and willfully, and maliciously lowering my credit score due to their ineptitude..

    I know I will get a settlement, but who should I sue?

    Advice will be appreciated, I want to file in District Court Tuesday.

    Yeah, I was thinking suing MBGA/JCP too, I would like to hold off on a suit agains EQU to get my bankruptcy off...

    Here's the story for that..

    I did file BK7 and was discharged Sept 01, it has already been removed from TU, and my TU is almost clean (only 4 negs left) because of an intent to sue letter...

    My BK7 is being reported to the CRA's as 0 liabilities, and 0 assets...as we all know, who would file bk7 under these circumstances..with 0 liabilities???

    Well, under the FCRA, this is INNACURATE, and INCOMPLETE info...they always verify with the court, and I have called the court myself, and for some reason....they say 0 as well....something happened to my records...

    How could I go about getting this OBVIOUSLY inacurrate information DELETED, as per the FCRA?

    Would a lawsuit help, it has come back verified 4x now....

    I will file against JCP/MBGA Tuesday, and let everybody know how it goes when their atty calls me!

    Doesn't someone that regularly posts on this board work at JC Penney's? Maybe that person can give some insight about JC Penney's possible weaknesses as a defendant.

    Somebody somewhere must have the inside track. I never had a JCP account by I have a close friend with a stinky old JCP problem that just won't let go.
