Lizardking, didn't you file your suit against the affiliate for Equifax? What prompted you to file against the affiliate instead of the CRA itself? I will be filing my first lawsuit in the very near future against Equifax or CSC, the local affiliate for Houston. I am a little confused as to which way to go. Can you give me some guidance on this? Since you were dealing with the affiliate, you need to go after the affiliate, at least. I suppose you could add equifax to the mix, but you definitely need to go after the affiliate. I'm sure Lizard will agree.
LKH, I know that CSC and Equifax are separate entities, but it would seem to me that CSC is basically a contractor for Equifax.
I sued my experian affiliate last fall. I did not sue experian. CSC is who you disputed with and they are the idiots that did the investigation. That is who you need to go after. Whether or not you include equifax, is up to you.
They fought me for a little while. They bumped it up to federal court and thought I would run because of it. I didn't, and we settled for deletion of everything I asked for. See
I filed in small claims. They had it moved to regular justice ct. and then to federal ct. I filed a motion against the transfer but the idiot justice ct. magistrate denied saying the FCRA says it must be heard in federal ct. It says it can be heard in any court of competent jurisdiction. I filed because they reinserted a deleted acct and couldn't prove that the acct had been "certified" correct as per the FCRA They also reinserted 2 collections without notifying me. They refused to remove an acct I had proof was supposed to have been deleted.
