I sent a variation of lizardking's validation letter and it worked to dog gone well. FCNB had a collection company dog me for settleling an accoount I have disputing as not mine for years. I sent the validation letter and the collection ran like a dog with its tail between its legs. here is what I got back:

    Dear ms. xxx

Regarding your recent request, we have sent a form in for deletion of the recent inquiry made to your credit report. Please allow 60-90days for deletion. If you have any questions please feel free to call us at xxxxxxxx.

xxxx has ceased further collection activity and returned your file to our client FCNB sincerely.

well at first glance this looks like a victory but I called the collector and he said they just gave the file back to FCNB. He apologized for any inconvience. I gathered that fcnb will just give the account to another collector agency what do I do?

Well...how old is the account? Maybe just maybe FCNB will work with you, otherwise I don't know what to tell you. At least you got the collection account off your report, and hope and pray they will work you with. Keep us posted. Good luck.

well I can not write the whole letter but it went something to the effect that validation does not mean address verification and that actual competent evidence is needed to prove contractual obligations. otherwise reporting invalid information to credit bureaus might constitute fraud. I also sent in a form with blanks to be filled in to verify when dates account last used and first used ect. they were to send this form back. mailed in with rr

OK I will keep you guys posted. I guess the letter worked as it should. But I still have some questions. How do I get them to get the account off of my cr? FCNb is listed on the report although they had this collection agency trying to collect the debt.
Do i just dipute through the cr and see if fcnb verifies.
Did I get this clear? That now I need to work with fcnb?
or just dipute through cr, or just validation demand through FCNB?

If he didn't get this letter by registered mail, would it hurt to send again/estopple?

    Lizardking,

What would have been the next move if the debt was validated? I have a case when I sent the validation letter and received a thick envelop with most of the documents signed when the account was open. Any suggestions will be appreciated. Thanks.

I got validation the same day I got my green card from them (Thursday). They sent a copy of my check (Collection Agency for returned check). I didn't received CRR, should I wait the 20 days and send estoppel or leave it alone and pay it? Or give it awhile and dispute again with CRA?

The collection agency IS collecting for a returned check to a business. That is the first letter I've sent them and they mailed me a copy of the check the same day they signed for the green card. They didn't send it CRR, so I'm not sure what to do next? The SOL is up on filing charges for the returned check so they can't prosecute...but should I pay it or will they just re-age the debt?

    Lizardking and co,

Thanks for the advice. The validation came from the original creditor.

Not sure if your reply was to me or gad. The amount in question for my account is $240. They did ignore ALL the information on the form. All they did was send a copy of the check with a post it note and an 800# to call to make a payment. NOTHING ELSE. It's only been like 8 days now. Do I wait out 30 days and send estoppel playing dumb? If I have to prove a paper trail, shouldn't they? If your response was not to me, help me out too.

Could you not also wait out the five days (I think) from the date on the CRR, and when they fail to notify the CRA' on their own, you have them on yet another violation?

    Re: lizardking letterworked to well

I have never paid them a dime. Start to finish is I noticed a CA on my credit report about 2 wks ago. Last week I sent a validation letter. On Thursday I received in my mailbox 2 things. 1. The green card signed by them. 2. An enevelope from them with a copy of the check they are collecting for (a returned check to a business) with a post it note and an 800# saying call this number to make payment. Nothing else. They ignored all the information on the validation form. It's simple. My question is Do I pay the $240 or pretend I never received the letter since it was NOT sent CRR?

It is an account closed check. The actual check is $179.88. I don't mind paying it, if I can get it deleted off. It is from 1998. Let me know.

I have a couple of CA listed on my CRs but I have never recieved any info from either. I currently disputing them as not mine online with TU and EXP. I'm trying to learn as much about validation as possible before I attempt to proceed.

Is validation a good technique for paid collection accounts? If not, suggestions are welcome.
