    WOW. Lkh i called her. boy what fun it was.

    I call, she puts me on hold for a few mins. Then i say my name and last name. Then she wants my social number. I say no. she got alittle offended. Then she's says how bout give me the 2nd 5 and 7th number. LOL. oh my god. i say no. Then she says do you owe this debt. i said i don't know. I don't remember. Then i say how do you know this my debt. She reads off the account number,etc. Then she said do you want me to read your socail back to you. i say no.

    Then she ask;s me how do you want me to help you. I say help me with what. I don't even know is its my debt. Then she says , yes we need your social security number. I say no. She is getting pissed, keeps saying how can i help you.I keep asking her How can i prove this is my debt.

    Then i ask her. You ever heard of a validation letter. She says yes.I said what is it. She says thats what we sent out. I said NO. A validation letter is sent by me to you, stating you must prove the debt. I said thats 1 violation. she got realllly pissed. laying this guilt trip on me about don't take it out on me, its just my job. Then i say You have to report to the 3 CRA:S within 5 days. Then i said . thats 2 violations. Now she was yelling. I said i have a total of 4 violations against you and im taking you to court.

    Then i say have you heard of the FDCPA. With a sarcastic reponse she say's yes. Then this reponse should be on the mastercard commercials as Priceless. All of the sudden she reads me the Miranda. LOL

    She is really whaco now. she keeps yelling how do you want me to help you.

    Then she repeats this 10 times. Are you refusing to pay this debt. YES or NO. i was nervous since my response included the word no. i thaught she mite be like a 3rd grader and say you said no. I said NO Comment. Keep repeating that over and over. THen She says would you like to speak with a Supervisor.With a cocky voice i said SURE. However i was on hold for 10 mins(suprise lol) i hung up.

    I haven't been this nervous in a long time waiting to talk with them. I keep thinking of what LKH and others said about admitting nothing. So the first part was very akward when she went the thing of confirming this was my debt. Which she never did.

    She said she has been calling my work for a couple months. I have never recieved any messages, nor any at home where she said she left them.

    So i think i may have hindered my settlement chances down the road if it comes to that. LOL.

    these people don't like it when we are better at the game than they are. They get used to running over people and making them feel helpless, when someone stands up for themselves with the law on their side it makes the little worms wiggle!

    UPDATE. The supervisor called me back. Real nice, just wants to help me. LOL. tryed the same crap. Read off the account number. He wanted to give me my social. i keep saying no. He finally read off the last 4 numbers. i said NO COMMENT. he repeated"no comment" and chuckled for a few seconds.


    He said we need to move on to the next step and get this debt squared away. i said didn't you recieve my two letters. He said what letters. I said my validation letter. He said i didnt see any letters.

    Then he gets back to the point of wanting to help me. Then i finally said why dont you respond to my letters and we will go from there. FINALLY. oh wait a minute. You mean the letter dated August 27th? Yeah since you didnt respond to the oringinal letter within 30 days WE dont have to validate?

    Since i didnt respond within 30 days. 1. can i still demand validation and they must respond within 30 days?2. is that still a violation under the fdcpa??


    Then i said i still have the right under the law to demand Validation. Then he said " I see how we are going to have handle this. Then he hung up.

    lkh said it mite be helpful since they called 2 days after recieving my estoppel letter. Plus lkk thaught i could get more violations against them. Mainly cause i was curious. Also they have not rersponded to the validation letter and called me.

    So she originally called you about something very important. What was so important, asking you if you were going to pay? Good. The super admitted he received your validation, they reported to the cra's after receiving it, they called you at least 2 times today to get you to pay. Keep piling up the violations idiots. Send them a demand to remove from the cra and demand that since they have no validation proof, they must close their books on this acct. Give them 15 days to do as you demand. Tell them if after 15 days they haven't responded appropriately, you will immediately on the 16th day forward it to your atty for further action as your atty has advised.

    Will do. All he could say was. you didnt request validation within the 30 days after you recieved the letter. I said under the LAW i have a RIGHT to request validation.


    The lady is a liar. Funny how she says she has been calling me for 2 months, and even said she left a message at my home last night. Also only today get the message at work that she called.

    Im just alittle confused as to why after recieving the estoppel she calls two days later. Then again all they want to do is help me right? lol.


    When the super called he even denied recieving the letters at first. Then i say, well the good ole post office has something called CRRR. Then he goes, wait are you referring to the letter dated august 27th?? LOL. what a dope.

    Well as he put it, at the end of the call. " now i know how were going to have to handle this"

    i can't wait. lol.

    . I sent out the estopell and they recieved it 5 days ago. giving them another 15 days. Should i send the letter you talked about now, or wait untill the 15 days are up?? thanks , lkh

    Ted, here's how they are going to handle this, lol...

    Them:

    "Man, that Tedfran is a nut. Did you hear how he kept saying 'No comment?' I'll bet he crapped in his pants when I said, 'Now I understand how we'll have to handle this.' Hahaha. What a nutcase. Well, let's just move on to one of the others on the list of debts we bought and hopefully get paid today! You know, this is a tough business. We know when we buy 'bad paper' (a stack of debts) that we're only going to collect on about 15% of them. Too bad we have to sift through the other 85% in order to get to payday. And aren't you glad that Tedfran doesn't realize we don't have the time, money, or desire to really take anybody to court? Sheesh if we did that all the time, we'd eat up our operating profit. Boy oh boy, that Tedfran had to be the nuttiest of the 85%. Ok, just put him back on the list to keep harassing, and let's move on to the next one on the list."

    That's why keeping the pressure up will ultimately make them roll over. And that's why so many of them simply give up when they get a particularly well-written intent-to-sue letter or -- even better -- a court summons.

    P.S. There is that tiny percentage who actually will go to court once in awhile of course, so be careful. If you continue to log their violations, you'll certainly win!

    Exactly. Since you just sent out the estoppel, wait til it has run it's time, then send a demand letter. It was particularly stupid of her to say she has been calling your work for 2 months since that also would be after receiving the validation. LOL Idiots are really going to cause themselves some problems.

    lol. that was great Doc. Im not to sure how court cases are handled or what. But there in CA, and im in the upper midwest. It;s 1,100.00. so i dont know if they would or not.


    Anyways there was a pause after he said that. he was probably hoping i would cave and ask what he meant. I just said Have a great night, God Bless. lol.
