LMAO at CA

    So, I review all the information from this old Medical Bill.

    It's only for $100, I'm not worried about the $$ but I want it off my CR.

    I call the CA and say "I'll send you a check, but I wan the account deleted"

    He said "That's illegal"

    I said "Not that I'm aware off"

    He than states "I'll delete it when I get your check"

    I said "Send me a letter that states that FIRST"

    He says "NO"

    than proceeds to tell me that the OC wants their $$, that I can call them all I want, they'll refuse to talk to me and send me back to him.

    Well I guess I'm getting the last laugh, I called the OC (who I've been speaking with all week), spoke with the Billing Manager and the Office Manager and exclaimed my disgust with the poor treatment by their CA, They Were Shocked! They are calling the CA and having the account deleted upon the OC's receipt of my payment, and they're getting it in writing!

    HAHAHAHAHAHA

    Oh yeah and let's not forget the classic statement...

    CA in a snotty tone: "You didn't think I'd respond, DID YOU?!"

    Me: "Of Course I assumed you would, providing you had the proper documentation. Why wouldn't you respond if this was a true valid debt?"

    CA: Silence

    ME: So Mr. XXXXX, let me remind you that

    #1. I wasn't 18 for a majority of these visits, so it would be Hmm Illegal? for you to report a bad debt on my CR that occurred before I was financially responsible for it?

    and

    #2. It's past the SOL TRY AND SUE ME!

    Dumb A$$

    Thanks!, but I think I spoke to soon. CA told OC they will not send them a letter stating deletion. However, OC said that after I pay it, and receive my receipt to Re-Dispute with TU and when TU calls to verify CA "promised" (yeah right) to not "reverify" the information that they will delete it.

    I don't trust CA at all, but OC pointed out very discreetly that hippa may apply.

    Yea, now is the time, before you do anything else to head to Whychat's site. He has some good info and the steps to take in regards to HIPPA.

    Actually I'm considering using his tactic for an account my fiance has regarding a hospital bill that is/has been paid from 98.

    For me though, I'm thinking off just taking my chances and sending TU a letter that states

    I was not 18 at the time the "contract" for services was signed, therefor I can not be held financially responsible for them, therefor it can not be reported to my CR as the contract was not valid.

    I was VERY polite with the CA, stated my point and that was it. He got all bent out of shape over nothing, and I realize he's doing his job, but I give respect to everyone and I deserve the same in return. I'm no less of a human being than he is and only God can judge me!

    I agree with you 100% jen.. you deserve just as much respect as anyone else.
    I dont understand the problem in deleting it from your cr if you agreed to pay it?
    If the CA's job is indeed simply to collect the payment then whats the problem?
    Sometimes I think these companies are somehow getting more money by keeping it on your cr.
    I am not sure how but it certianly seems that way..

    Hiding.....I have a feeling you have an opinion on this?? :) As you do everything else!

    Its seems to me it should be illegal for them not to.
    since you paid them I dont see how its "illegal" for them to delete it..
    however I will wait for hidings answer as well :)

    It is only ILLEGAL to report incorrect information.

    There is no provision of the FCRA which requires that anyone report anything.

    If there were, you could sue every company that you have any type of business relationship with for failure to report on your credit files. :)

    They DECIDE if, when, and with which credit reporting agencies which they report to.

    Is the OC local enough that you could make the payment in person?

    If so, here is what I would do personally...

    Since they refuse to provide the letter before the $ is in the OC's hands.

    Take the $ to the OC personally. Let them see it, but not have it, yet...

    Have the OC send a fax to the CA "THIS ACCOUNT IS BEING RECALLED AS SUBMITTED IN ERROR".

    Have the CA send a fax to the OC stating that the trade line will be deleted.

    After you have the CA's fax in your hands, *THEN* let the OC have the $...

    Yes the OC is VERY local, down the street local...but

    But, I have to send the money to the CA not the OC, per the OC.

    I was thinking of using WhyChat's tactic of sending the Check with the Hippa letter to the OC
